SUBJECT: CLAIM AGAINST THE CITY BY CHERYL ROBINSON

RECOMMENDATION

Reject the claim and direct staff to notify the claimant.

BACKGROUND/DISCUSSION

The claimant alleges a rock hit her parked car’s windshield on Camino Porvenir on September 24^th. There were no witnesses reported at the time of the incident. The claimant stated that the damage was due to street repairs associated with replacing cement around manhole covers. A copy of the claim is attached.

The City’s Claims Administrator, Carl Warren & Company has investigated the claim and has advised the City to reject the claim. Carl Warren & Company will tender the claim to the City’s contractor, Excel Paving Company, which was working in the area as part of the City’s Residential Street Overlay and Slurry Seal Project.
