MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: SENIOR ADMINISTRATIVE ANALYST DATE: NOVEMBER 5, 2002 SUBJECT: CLAIM AGAINST THE CITY BY LANTZ SIMPSON RECOMMENDATION Reject the claim and direct staff to notify the claimant. BACKGROUND/DISCUSSION Lantz Simpson filed a claim for damages to car tires while driving on Los Verdes Drive on August 15, 2002. The claimant alleges the damages were due to the negligence of the City contractor, Excel Paving, which was working in the area as part of the City’s Street Overlay and Slurry Seal Project. A copy of the claim is attached. The City’s Claims Administrator, Carl Warren & Company has investigated the claim and has advised the City to reject the claim. Carl Warren & Company will tender the claim to the City’s contractor, Excel Paving Company, so the claimant can file damages directly with the City contractor.
