MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS FROM: SENIOR ADMINISTRATIVE ANALYST DATE: NOVEMBER 19, 2002 SUBJECT: CLAIM AGAINST THE CITY BY WAYNE RICHTER RECOMMENDATION Reject the claim and direct staff to notify the claimant. BACKGROUND/DISCUSSION The claimant alleges a City contractor, Excel Paving Company, failed to cone off a newly painted area in a road construction zone on Marquerite Drive on September 30, 2002. The claim is for the cost of removing the yellow paint on his car. A copy of the claim is attached. The City’s Claims Administrator, Carl Warren & Company has investigated the claim and has advised the City to reject the claim. Carl Warren & Company will tender the claim to the City’s contractor, Excel Paving Company, which was working in the area as part of the City’s Residential Street Overlay and Slurry Seal Project.
