TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DIRECTOR OF PUBLIC WORKS DATE: DECEMBER 17, 2002 SUBJECT: ADDITIONAL FUNDING FOR THE STORM WATER PROGRAM RECOMMENDATIONS
BACKGROUND On November 18, 2002, the City received an invoice from the State Water Resources Control Board for an annual fee for waste discharge, and the storm water permit. The State Water Code requires these fees. This is the first time cities have been assessed these fees. The adopted budget does not include any funding for this expense. CONCLUSION Adopting the staff recommendations will provide funding for the City to pay a fee to the State of California that is required by law. ALTERNATIVE ACTIONS Staff could not identify any alternative actions. FISCAL IMPACT This expense was not anticipated in the adopted FY2002-2003 budget. In addition the adopted budget estimated General fund revenues would exceed General expenses by only $827. Therefore this project will need to be funded from the General fund reserve. The amount of the project General fund reserve available for appropriation (which is the total General fund reserve less the General fund reserve policy level of $6,451,870) is summarized below.

RESOLUTION NO. 2002- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING RESOLUTION 2002-45, THE BUDGET APPROPRIATION FOR FISCAL YEAR 2002-03, FOR A BUDGET ADJUSTMENT TO THE CITY’S GENERAL FUND – PUBLIC WORKS ADMINISTRATION WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council; and WHEREAS, on June 12, 2002, the City Council of the City of Rancho Palos Verdes adopted Resolution 2002-45, approving a spending plan and authorizing a budget appropriation for the 2002-03 fiscal year; and WHEREAS, it is necessary for the City to allocate additional funds for the National Pollution Discharge Elimination System(NPDES)/Clean Water Act Implementation; and WHEREAS, a budget increase in the General Fund – Public Works Administration is necessary to authorize the expenditure of additional funds for State Water Resources Control Board (SWRCB) fees for Waste Discharge and for an increase in the annual Storm Water Permit.
