SUBJECT:RYAN PARK IMPROVEMENT PROJECT

RECOMMENDATIONS:

1. Accept work as completed.
2. Authorize the City Clerk to file the Notice of Completion with the County Recorder; and if no claims are filed 35 days after recordation, notify the surety company to exonerate the Payment and Performance Bonds.
3. Authorize the Director of Public Works to release the 10% retention payment to

Vido Samarzich, Inc. 35 days after recordation of the Notice of Completion by the County Recorder contingent on no claims being filed on the Project.

BACKGROUND:

On September 3, 2002, the City Council authorized the purchase new playground equipment for Ryan Park and on December 3, 2002; the City Council awarded a construction contract to Vido Samarzich, Inc. for the construction of the Ryan Park Improvement Project. Pursuant to the approved contract, the work has been satisfactorily completed at the following cost:

*Change Order work included: the installation of an additional drinking fountain, the construction of two drinking fountain drain sumps, the removal of additional concrete curb, encasing a 12" storm drain line with concrete to protect the line in place, constructing eight new concrete steps as part of an existing stairway to lessen the grade on a new sidewalk, installing additional safety hand railing along one side of the playground pod for 2-5 year olds, and upgrading the binder for the rubberized playground surface to prevent discoloration.

CONCLUSION:

Vido Samarzich, Inc. has successfully completed all work in accordance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion (attached) filed.

FISCAL IMPACT:

The recommended actions will have no fiscal impact.
