SUBJECT: REduction in the REQUIREMENT FOR WHAT CONSTITUTES A Quorum OF THE General Plan Update Steering Committee

RECOMMENDATION

That the City Council adopt Resolution No. 2003-__, reducing the quorum level for the General Plan Update Steering Committee from 8 members to 6 members.

BACKGROUND

As a first step toward updating the General Plan the City Council created a 15-member General Plan Update Steering Committee (Committee) with the purpose of focusing on the existing Goals and Policies of the General Plan to determine if these goals and policies need revision. At the end of their review, the Steering Committee will be responsible for reporting back to the City Council as to which Goals and Policies need to be eliminated, revised or maintained, and if any new Goals and Policies should be proposed, and what technical areas of the General Plan need updating.

DISCUSSION

The Committee held their first meeting on October 30, 2002. At the meeting, the Steering Committee, which is chaired by Planning Commissioner Tom Long, selected a Vice-Chair, Finance Advisory Committee Member Steve Wolowicz. The Committee also adopted a process and schedule for reviewing the General Plan Goals and Policies. At their subsequent meetings, held on November 20, 2002, December 18, 2002, and February 17, 2003, the Committee has worked very hard reviewing the Goals and Policies of the General Plan's Natural Environment Element. It is anticipated that the Committee may complete their review by the end of this year.

As approved by the City Council, the original Committee included the following 15 members:

As noted previously to the City Council, the School District has decided not to serve on the Steering Committee. With the absence of the School District seat, the Steering Committee is now comprised of 14 members.

In order for the Committee to meet they must have a quorum of 8 members. Unfortunately, the Committee has been having some trouble in reaching a quorum. For example, at their December meeting, only 8 of the 14 members attended, with the 8th showing up late. Further, the January meeting had to be cancelled as only 7 members were in attendance. Staff believes that the main difficulty is partly due to the large size of this 14 member Committee as well as due to the fact that each Committee Member is also involved on a separate Committee and/or Commission that serves the City. Although the Committee meeting dates have been scheduled not to conflict with other citywide meetings, the Committee has requested that the quorum level be reduced to 6 members.

CONCLUSION

Based upon the information presented in this report, and at the request of the Committee, Staff recommends that the City Council adopt Resolution No. 2003-__, reducing the quorum level of the General Plan Update Steering Committee from 8 members to 6 members.

RESOLUTION NO. 2003-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES REDUCING THE QUORUM LEVEL FOR THE GENERAL PLAN UPDATE STEERING COMMITTEE FROM 8 MEMBERS TO 6 MEMBERS

WHEREAS, On April 2, 2002, as a first step toward updating the General Plan, the City Council created a 15-member General Plan Update Steering Committee (Committee) with the purpose of focusing on the existing Goals and Policies of the General Plan to determine if the goals and policies need revision; and

Whereas, the Committee has conducted meetings on October 30, 2002, November 20, 2002, December 18, 2002, and February 17, 2003; and

Whereas, because the Committee has been having some trouble in reaching a quorum, such as at their December meeting where the meeting was delayed until a quorum could be reached and at their January meeting which had to be cancelled as only 7 members were in attendance, at their February 17, 2003 meeting, the Committee requested that the City Council reduce the quorum level for this Committee from the current 8 members to 6 members; and

WHEREAS, on March 4, 2003, the City Council considered the Committee's request, at which time all interested parties were given an opportunity to be heard and present evidence; and,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:

Section 1: That due to the large size of this 14 member Committee, and that each Committee Member is also involved on a separate Committee and/or Commission that serves the City, and that this Committee serves only as an advisory body to the City Council, the quorum level can be reduced.

Section 2: For the foregoing reason and based on the information contained in the staff report and evidence presented, the City Council of the City of Rancho Palos Verdes hereby reduces the quorum level for the General Plan Update Steering Committee to 6 members.
