TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DIRECTOR OF PLANNING, BUILDING AND CODE ENFORCEMENT DATE: MARCH 18, 2003 SUBJECT: RESOLUTION UPHOLDING THE APPEAL OF THE PLANNING COMMISSION’S DENIAL OF A CONDITIONAL USE PERMIT REVISION FOR PROPOSED MODIFICATIONS TO FOUR (4) LOTS IN THE OCEANFRONT COMMUNITY, LOCATED AT 32, 34, 36 AND 38 VIA DEL CIELO (PLANNING CASE NO. ZON2002-00282) Staff Coordinator: Kit Fox, AICP, Senior Planner RECOMMENDATION Continue this matter to the City Council meeting of April 15, 2003. DISCUSSION On February 18, 2003, the City Council upheld the developer’s appeal. Staff prepared a draft Resolution and conditions of approval for the Council’s consideration on March 4, 2003. However, at that time the developer was still "fine tuning" the grading and revegetation plan, and had concerns about several of Staff’s recommended conditions of approval. At the developer’s request, this matter was continued to tonight’s meeting so that the conditions could be tailored to be consistent with the developer’s proposal. Unfortunately, the revised grading and revegetation plans were not completed in time to be analyzed by Staff for discussion tonight. Therefore, Staff recommends continuing this matter to April 15, 2003.
