SUBJECT: FUNDING REQUEST FOR BEVERAGE CONTAINER RECYCLING AND LITTER CLEANUP ACTIVITIES FY 03-04

RECOMMENDATION

1. Authorize the submittal of the funding request to the Department of Conservation, Division of Recycling, for funding programs related to beverage container recycling and litter cleanup activities for FY 03-04.
2. Adopt Resolution 2003- ___, authorizing the Director of Public Works to execute all necessary forms for the purposes of securing payments, and implementing and carrying out the programs.

BACKGROUND

Effective January 1, 2000, Senate Bill 332 mandated changes to the existing law governing the Beverage Container Recycling and Litter Reduction Program, including an appropriation for $10.5 million to be expended annually as payments to cities and counties for beverage container recycling and litter cleanup activities. The Department of Conservation, Division of Recycling (DOR), administers this program. Funds are from deposits, California Redemption Value (CRV), collected from customers when purchasing different beverage containers such as sport drinks, coffee and tea beverages, water, distilled spirit coolers, beer and malt beverages and fruit drinks at stores. The FY 03-04 grant will be the 5th year of this annual block grant program.

DISCUSSION

Payments to cities are calculated on a per capita basis. The City’s share for FY 03-04 is $11,931. Funds are paid for eligible activities starting July 1, 2003. The funding request and Resolution No. 2003- ___ must be submitted by April 30, 2003.

The following are qualifying eligible activities:

• Collecting and recycling of CRV beverage containers at large venues, public areas, residential communities and multi-family dwellings, schools and businesses
• Public Education and/or promotion of CRV beverage container recycling, and/or litter prevention and cleanup
• CRV Beverage container litter prevention and/or abatement in public places

For the FY 03-04 allocation, staff proposes the following programs and activities similar to the past couple of years:

• Servicing and maintaining the concrete recycling bins at various park sites. This will offset General Fund expenditures of approximately $1,930.
• Litter pick up and cleanup at roadside and public right of way areas. This will offset Gas Tax expenditures of approximately $10,000.

Staff time for administering this annual program (approximately $300) will be absorbed by the Solid Waste fund.

ALTERNATIVE

The alternative would be to not submit a request for funding for FY 03-04. No funding will be received if the alternative is approved.

FISCAL IMPACT

If authorized, the City will receive approximately $12,000 each year. This will help fund existing programs and fund new activities promoting beverage container recycling.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING STAFF TO SUBMIT A FUNDING REQUEST FORM TO THE DEPARTMENT OF CONSERVATION, DIVISION OF RECYCLING, FOR BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION PROGRAMS

WHEREAS, the people of the State of California have enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage container recycling and litter cleanup activities; and

WHEREAS the California Department of Conservation, Division of Recycling, has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures for cities and counties or their designees under the program; and

WHEREAS, per Section 14581 (a)(4) (E) of the California Beverage Container Recycling and Litter Reduction Act, the eligible participant must submit the Funding Request Form by the due date and time in order to request funds from the Department of Conservation, Division of Recycling.

BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:

That the City Council authorizes the submittal of the Funding Request Form to the Department of Conservation, Division of Recycling. The Director of Public Works, is hereby authorized and empowered to execute in the name of the City of Rancho Palos Verdes all necessary forms hereto for the purposes of securing payments and to implement and carry out the purposes specified in the Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and provide information regarding this program to the Division upon request.
