SUBJECT: APPEAL OF HEIGHT VARIATION, SITE PLAN REVIEW, AND MINOR EXCEPTION PERMIT CASE NO. ZON2002-00605 (YOUNGGREN, 4362 EXULTANT DRIVE)

Accept the withdrawal of the appeal and take no further action on this item.
On February 11, 2003, the Planning Commission approved Height Variation, Site Plan Review, and Minor Exception Permit Case No. ZON2002-00605, to allow the construction of a 1,329 square foot first-story addition and the construction of a new 755 square foot second-story addition to an existing single-family residence on 4362 Exultant Drive.
Subsequent to the Planning Commissionís decision, on February 25, 2003, the City received an appeal letter from the Matura Family, who reside at 4394 Dauntless Drive, appealing the Planning Commissionís decision to the City Council because of privacy concerns. A public hearing notice was sent to the property owners within a 500í radius of the subject property notifying them of the April 15, 2003 City Council meeting, where the appeal would be heard.
After the project was duly noticed, the Director of Planning, Building and Code Enforcement met with the appellants and the property owner to understand the appellantís concern with privacy and to explain the conditions of approval that addressed privacy. As a result of this meeting, on March 24, 2003, Frank and Lisa Matura formally withdrew their appeal, as stated in the attached e-mail, and a public hearing on this matter is no longer required.
