SUBJECT: NOTICE OF COMPLETION – SAN RAMON DRAINAGE AND LANDSLIDE STABILIZATION PROJECT

RECOMMENDATIONS:
- Accept the work as complete.
- Authorize the City Clerk to file the notice of completion with the County Recorders Office; and if no claims are filed 35 days after recordation, notify the surety company to exonerate the Payment and Performance Bond with Colich & Sons, Inc.
- Authorize the Director of Public Works to release 5% retention payment to Colich & Sons, Inc. 35 days after recordation of the Notice of Completion contingent upon no claims being filed against the contractor.
BACKGROUND & ANALYSIS
On October 2, 2001, City Council awarded a construction contract to Colich & Sons, Inc. for the construction of the San Ramon Drainage and Landslide Stabilization Project in the amount of $2,250,556.00 and authorized staff to spend an additional $157,540 for anticipated extra items. On October 15, 2002, and March 4, 2003, City Council authorized construction expenditure increases of $140,000 and $147,644 respectively, for a total authorization of $2,695,740.00. Pursuant to the approved contract and approved change orders, the work has been satisfactorily completed at the following cost:

FISCAL IMPACT
The recommended action will have no fiscal impact.
CONCLUSION
Colich & Sons, Inc. has successfully completed all work in accordance with the plans and specifications for this project. Therefore, the work should be accepted as complete and a Notice of Completion filed.
