TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ASSISTANT CITY MANAGER DATE: JULY 1, 2003 SUBJECT: BUDGET ADJUSTMENT FOR STUDENT AND THE LAW RECOMMENDATION Adopt Resolution No. 2003- ; amending Resolution No. 2003-42 for a budget adjustment to the General Fund to fund Student and the Law during the 2003-2004 school year. DISCUSSION On June 17, 2003, Council considered whether to provide separate funding for the Student and the Law program in the City Budget. As adopted on June 3, 2003, the budget folded Student and the Law into the Grant Deputy program, with the expectation that the CORE Deputies would teach the classes during the upcoming school year as part of their regular duties. Principal Kelly Johnson testified that that the CORE Deputies would be unable to teach the classes at Peninsula High School, because they do not hold state teaching credentials. Separate funding would allow Deputy Tony Del Pinto, who holds the required credential, to continue teach the classes at both Peninsula High School and Rancho del Mar Continuation School. Based on this new information, Council directed staff to return with a Resolution for a General fund appropriation of $20,406 to fund the Student and the Law program in FY 03-04. The draft Resolution is attached for the City Council’s consideration and adoption. FISCAL IMPACT This budget appropriation would reduce the estimated General fund reserve of $8,274,681 to $8,254,275. Respectfully submitted:

Les Evans City Manager Attachment: Resolution No. 2003- ; RESOLUTION NO. 2002- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AMENDING RESOLUTION NO. 2003-42, THE BUDGET APPROPRIATION FOR FISCAL YEAR 03-04, FOR A BUDGET ADJUSTMENT TO THE CITY'S GENERAL FUND WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council; and, WHEREAS, on June 3, 2003 the City Council of the City of Rancho Palos Verdes adopted Resolution No. 2003-42, approving a spending plan and authorizing a budget appropriation for the 2003-2004 fiscal year; and, WHEREAS, in the budget adopted on June 3, 2003, the Student and the Law program is funded as part of the CORE Deputy grant program; and, WHEREAS, on June 4, 2003, Mayor Pro Tem Ferraro requested that the issue of separate funding for the Student and the Law program be agendized for discussion at the June 17, 2003 City Council meeting; and, BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES: Section 1: Based on the testimony provided at the June 17, 2003 meeting, the City Council finds that in order to continue the Student and the Law program at Peninsula High School during the 2003-2004 school year, separate funding of the program is required.
