Adopt Resolution No.___ ELECTING TO CEASE TO BE SUBJECT TO THE PUBLIC EMPLOYEES’ MEDICAL AND HOSPITAL CARE ACT.

At their meeting of August 19, 2003 the City Council adopted a Resolution Electing to Cease to be subject to the Public Employee’s Medical and Hospital Care Act. That Resolution was delivered to CalPERS within the required time frame. Now CalPERS has advised us that the City must pass an identical resolution to remove elected officials (non-PERS employees) from the health program.

CalPERS requires a separate resolution to remove the four City Councilmembers who have health insurance through the CalPERS program.

WHEREAS, Government Code Section 22853 provides that a contracting agency which has elected to be subject to the Public Employees’ Medical and Hospital Care Act may cease to be so subject by proper application by the contracting agency; and

WHEREAS, City Council of Rancho Palos Verdes, hereinafter referred to as Special District is a contracting agency under the Act for participation by members of the City Council now, therefore be it

RESOLVED, That the City Council members of the Special District elect, and it does hereby elect, to cease to be subject to the provisions of the Act; and be it further

RESOLVED, That coverage of the Act cease on December 31, 2003.
