BACKGROUND In March 2002 the voters of California passed Proposition 40, the "California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002". The allocations for the Per Capita Program and the Roberti-Z'berg-Harris (RZH) Block Grant Programs under the 2002 Resources Bond Act have been finalized by the State and funds have been included in the FY 03-04 State budget. This act makes $220,000 in Per Capita Allocation and $113,221 in RZH Block Grant Allocation available to the City for acquisition of park and recreation lands and facilities, development/rehabilitation of park and recreation lands and facilities, special major maintenance of park and recreation lands and facilities. There is no match requirement for either fund. DISCUSSION On March 4, 2003, the City Council approved an expenditure plan for the Proposition 12, Proposition 40 and available Measure A bond funds. The approved City FY 03-04 budget- Infrastructure Improvements Fund, has budgeted the amount of $844,087 from Proposition 12 and 40 funds, and the amount of $155,913 from Measure A funds for a total of $1,000,000 towards open space acquisition. The balance of $28,012 in un-programmed Proposition 40 funds may be allocated in the future towards other eligible projects or programs.
The State of California has requested that the City adopt two resolutions, which formulizes the allocation of Proposition 40 funds. The approval of these two resolutions does not obligate the City to any specific project at this time. It simply sets the funds aside for future City approved project(s). However, the City will be required to have a fully executed contract by June 30, 2006. ALTERNATIVE The alternative would be to not submit any resolutions applying for grant funds. Staff does not recommend this because this application only encumbers the funds for the City. The City then has time to choose a project(s) and fill out the required application form(s). FISCAL IMPACT If adopted, the City will encumber $220,000 in Per Capita Allocation and $113,221 in RZH Block Grant Allocation under the 2002 Resources Bond Act (Proposition 40).
