SUBJECT: CLAIM AGAINST THE CITY BY JOSEPH PELEZZARE

RECOMMENDATION

Reject the claim and direct staff to notify the claimant.

BACKGROUND/DISCUSSION

The claimant, Joseph Pelezzare alleges private property damage due to a tree falling down on his fence on September 25, 2003. The city’s contractor, Damon Construction, allegedly trimmed the roots of the tree while repairing a sidewalk a month before the date of the claim incident. The claim amount is $1,781.03 for fence repairs and tree debris removal expenses. A copy of the claim is attached.

The City’s Claims Administrator, Carl Warren & Company has advised the City to reject the claim.
