SUBJECT: MIRALESTE RECREATION & PARKS DISTRICT: CONFIRMATION OF APPOINTMENT OF BOARD MEMBER

RECOMMENDATION

Confirm the appointment of Nancy Otto to the Miraleste Recreation & Park District for a term of office until November 2005.

BACKGROUND

The Miraleste Recreation & Park District is an independent special district formed on June 14, 1940. The purpose of the District is to:

• Provide for the development, operation, and maintenance of parklands;
• Provide residents with public park maintenance of landscape improvements that include medians, parking parcels, cul-de-sacs, and other open spaces;
• Maintain and develop parkland areas in accordance with the needs and wishes of the residents;
• Provide fire prevention and clearing of parkland areas;
• Provide improvements of the trail system accessibility; and,
• Balance and preserve woodland atmosphere.

Miraleste is comprised of approximately 350 acres, is located in the southeast portion of the City; and consists of 390 parcels with a population of 970 people. The District is governed by a five member board of directors that meet the first Monday of every even number month.

The City has been notified that board member Ms. Kimberly Stull has resigned from the Board; her term of office was due to expire in November 2007. Board Chair Peter Glusac has submitted a letter stating that the on June 7, 2004 Ms. Nancy Otto was appointed to fill this vacancy. While the Board is the appointing authority for its members, according to the California Public Resources Code Section 5780.1 (Supervising authority, defined), the City Council is the supervising authority for the District and must confirm this appointment.

CONCLUSION

Miraleste Recreation & Park District is one of the City’s special districts that is governed by a five member board of directors. One of these board members has resigned and according to the Public Resources Code the Council must now confirm the appointment of Ms. Otto to fill the Board vacancy.
