SUBJECT: ELECTION COSTS: BUDGET ADJUSTMENT

RECOMMENDATION

ADOPT RESOL. NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING RESOLUTION NO. 2003-42, THE BUDGET APPROPRIATION FOR FISCAL YEAR 2003-2004, TO INCREASE THE BUDGET FOR THE CITY’S GENERAL FUND.

INTRODUCTION

The cost of the November 2003 election is more than what was budgeted for in the FY 2003-04 budget. Staff is requesting an increase in the Administrative Services budget program to pay this additional cost.

BACKGROUND

The FY2003-04 budget allocated $49,000 for the November 2003 General Municipal Election. That figure was determined early in the budget process and was based upon the customary sharing of costs between the City, the Palos Verdes Library District and the Palos Verdes School District for services provided by the County of Los Angeles during the election process. Attached is a breakdown of those services provided by the County Registrar-Recorder/County Clerk.

This past November there were two seats up for election on the Library Board and only two candidates filed papers. In a situation like this, the California Elections Code provides for the appointment of the candidates and relieves a jurisdiction of having to hold an election.

While the entire City of Rancho Palos Verdes is within the boundaries of the Library District, this is not the case with the School District. Eastview is not within the School District boundaries and, consequently, all of the costs associated with conducting the election within the Eastview precincts were borne entirely by the City. Costs for the remainder of the City were shared with the School District in the usual manner.

The additional cost for the election is $24,175.54; however, the cost of processing absentee ballots ($8,189.60), can be recovered by the City through the provisions of SB90. The City contracts with Cost Recovery Systems, Inc. who submits the City’s claims on an annual basis to the State for recovery of State mandated costs.

FISCAL IMPACT

Staff requests a budget adjustment in the amount of $24.175.54 to cover the additional costs of the November 2003 election.

CONCLUSION

The costs associated with City’s election are customarily shared with the Palos Verdes Library District and the Palos Verdes School District. This past November, however, these costs were shared only with the School District and this resulted in additional expense to the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING RESOLUTION NO. 2003-42, THE BUDGET APPROPRIATION FOR FISCAL YEAR 2003-2004, TO INCREASE THE BUDGET FOR THE GENERAL FUND

WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council; and,

WHEREAS, on June 3, 2003, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 2003-42, approving a spending plan and authorizing a budget appropriation for FY03-04; and,

WHEREAS, on November 4, 2003 the City of Rancho Palos Verdes held an election which was consolidated with the Palos Verdes Unified School District and the Palos Verdes Library District elections; and,

WHEREAS, because after the close of the nomination period, it was determined that the Palos Verdes Library District would not be required to conduct an election in November 2003, the City was unable to share costs for certain election services performed by the Los Angeles Registrar-Recorder/County,

BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:

The following adjustments be made to the FY03-04 budget:

Increase the General fund budget as follows:

Professional/Technical Services #001-104-35 Elections $24,175.54
