TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: CAROL LYNCH, CITY ATTORNEY DATE: JULY 6, 2004 SUBJECT: RESOLUTION ACCEPTING QUITCLAIM DEEDS FROM THE COUNTY OF LOS ANGELES TO THE CITY OF RANCHO PALOS VERDES FOR THE PROPERTIES LOCATED AT 31501 PALOS VERDES DRIVE SOUTH (COMMONLY REFERRED TO AS THE POINT VICENTE INTERPRETIVE CENTER) AND 31200 PALOS VERDES DRIVE SOUTH (COMMONLY REFERRED TO AS "THE FISHING ACCESS") RECOMMENDATION Adopt the attached resolution, which provides for the City Council’s acceptance of the real property interests conveyed by the Quitclaim Deeds from the County of Los Angeles to the City of Rancho Palos Verdes for the properties located at 31501 Palos Verdes Drive South, commonly referred to as the Point Vicente Interpretive Center (the "PVIC Property"), and 31200 Palos Verdes Drive South, commonly referred to as "The Fishing Access." BACKGROUND As the Council is aware, during the settlement of the issues concerning the lead contamination at the PVIC Property, the City and the County of Los Angeles each expressed an interest in having the County convey that property to the City along with the property located at 31200 Palos Verdes Drive South (hereinafter referred to as the "Fishing Access Property"). The County has agreed to convey these two properties to the City, subject to the restriction that both properties must be used solely for public park and recreational uses. On December 16, 2003, the County executed Quitclaim Deeds conveying the PVIC Property and the Fishing Access Property to the City. Government Code Section 27281 provides that deeds conveying any interest in real property to the City for public purposes cannot be accepted for recordation without the consent of the City as indicated by a certificate of acceptance attached to or printed on the deed or grant. Section 27281 further provides that the City may accept deeds conveying real property interests by action of the City Council. The attached Resolution has been prepared to provide for the City Council’s acceptance of the real property interests conveyed to the City by the Quitclaim Deeds and the City Council’s consent to recordation of said deeds by the City Manager. The Resolution also authorizes the City Manager to execute the Certificates of Acceptance, which are attached to the Quitclaim Deeds, on behalf of the City.
The fiscal impact to the City that will result from the adoption of the attached Resolution is the annual cost for the City to maintain these two properties. Since the City already maintains the PVIC Property, pursuant to the existing lease with the County, the only additional cost from this transaction is the cost of maintaining the Fishing Access Property. Respectfully submitted, Reviewed by, Carol Lynch Les Evans City Attorney City Manager Attachments: Two Grant Deeds Resolution RESOLUTION NO. ____ A RESOLUTION OF THE CITY COUNCIL OF THE WHEREAS, the City of Rancho Palos Verdes (the "City") and the County of Los Angeles (the "County") have agreed that the County will convey to the City the property located at 31501 Palos Verdes Drive South, commonly referred to as the Point Vicente Interpretive Center (the "PVIC Property") and the property located at 31200 Palos Verdes Drive South, commonly referred to as "The Fishing Access" (hereinafter referred to as the "Fishing Access Property"), subject to the restriction that both properties must be used solely for public park and recreational uses; and WHEREAS, on December 16, 2003, the County executed Quitclaim Deeds conveying the PVIC Property and the Fishing Access Property to the City; and WHEREAS, Government Code Section 27281 provides that deeds conveying any interest in real property to the City for public purposes cannot be accepted for recordation without the consent of the City evidenced by a certificate of acceptance attached to or printed on the deed; and WHEREAS, Government Code Section 27281 further provides that the City may accept deeds conveying interests in real property by action of the City Council; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City Council hereby accepts the interests in real property conveyed by the Quitclaim Deeds dated December 16, 2003, from the County of Los Angeles to the City of Rancho Palos Verdes, for the PVIC Property and the Fishing Access Property. The Quitclaim Deed for the PVIC Property is attached hereto as Exhibit "A" and incorporated herein by this reference, and the Quitclaim Deed for the Fishing Access Property is attached hereto as Exhibit "B" and incorporated herein by this reference. Section 2. The City Council hereby authorizes the City Manager to execute the Certificates of Acceptance attached to the Quitclaim Deeds for the PVIC Property and the Fishing Access Property, which are set forth in attached Exhibits "A" and "B". Section 3. The City Council hereby consents to the recordation of the Quitclaim Deeds for the PVIC Property and the Fishing Access Property.
