SUBJECT: CONTINUED HEARING REGARDING COX COMMUNICATIONS NOTICE OF NON-COMPLIANCE

RECOMMENDATION

Continue the public hearing to September 21, 2004.

DISCUSSION

The City Council first considered this item on May 4, 2004. At the meeting, Cox Communications submitted additional materials in response to staff’s findings that the cable operator was out of compliance with several provisions of the Cable Television Franchise Agreement. Council continued the public hearing to tonight’s meeting in order to give staff time to review and analyze the additional material. Because Mayor Gardiner is unable to attend this evening’s meeting, he requested that this item be continued until a date when all of the Council members are expected to be in attendance. Given the fact that the summer holiday season is fast approaching; staff suggests continuing the public hearing until after Labor Day.
