SUBJECT: PLANNING COMMISSION VACANCY: APPOINTMENT PROCESS

RECOMMENDATION

Determine whether to conduct a new recruitment, or appoint one of the candidates who participated in the interview process in January 2004.

DISCUSSION

With the resignation of Planning Commissioner Sam Van Wagner (see attached letter) Council needs to decide whether to conduct a new recruitment or consider appointing one of those candidates who participated in the interview process earlier this year. Mr. Van Wagner’s term of office was due to expire in January 2006.

As a result of the City’s recruitment efforts last December, the City Council interviewed twelve candidates for the Planning Commission: five of those candidates were subsequently appointed to the Planning Commission. Attached are the resumes of those candidates not appointed.

Appointment Process

Council Policy No. 6 adopted in January 2002 set the recruitment process for City advisory boards as follows:

1. Immediately following the regular election of council members the City Clerk shall advertise that applications shall be open for the positions that shall be filled following the seating of a new city council. Applications shall be accepted from the date following the election until mid-December of that year, or such other date, as the city council shall direct. The newly seated city council shall determine the interview schedule.

2. The vacancy shall be advertised in the Palos Verdes News, Daily Breeze and LA Times newspapers. Advertising may take the form of a press release. Additionally, the vacancy shall be posted at the City’s regular posting places and be placed on the Government Access Reader Board. The City Clerk shall include a summary of duties in the recruitment flyer, press release and any other recruitment material. A deadline for receipt of applications will be established by the City Council

3. Interested applicants, including incumbents seeking reappointment, will be required to fill out applications.

4. Applications will be reviewed by the City Council. Each applicant shall be interviewed by the City Council and appointments made at a public meeting.

If the Council decides to follow this process, a deadline date of September 27th could be set for the submittal of applications. These applications could then be presented on the October 5th City Council agenda; Council would then have to set a date to interview the candidates.

Unscheduled Vacancy

If the Council decides to forgo the recruitment process and make an appointment at this meeting, the Maddy Act provides for the following:

"(a) Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, the library designated pursuant to Section 54973, and in other places as directed by the legislative body, not earlier than 20 days before or later than 20 days after the vacancy occurs. Final appointment to the board. . .shall not be made by the legislative body for at least 10 working days after the posting of the notice in the clerk’s office.

(b) Notwithstanding subdivision (a), the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section."

If an appointment is made on an acting basis, the Special Vacancy Notice could be posted on September 8th, and then the appointment would be brought back for confirmation on the September 21st Council agenda.

CONCLUSION

A vacancy exists on the seven-member Planning Commission and the Council has the choice of either conducting a regular recruitment, or making an appointment on an acting basis as permitted under the Maddy Act.
