SUBJECT: CONTINUED HEARING REGARDING COX COMMUNICATIONS NOTICE OF NON-COMPLIANCE

RECOMMENDATION

Continue the public hearing to October 19, 2004.

DISCUSSION

The City Council first considered this item on May 4, 2004. At the meeting, Cox Communications submitted additional materials in response to staff’s findings that the cable operator was out of compliance with several provisions of the Cable Television Franchise Agreement. Council continued the public hearing to tonight’s meeting in order to give staff time to review and analyze the additional material. Because traffic calming issues are expected to dominate this evening’s agenda with many public speakers expected on these topics, staff suggests continuing the public hearing until the second meeting in October when the schedule is expected to lighter. Staff has spoken with Arthur Yoon, Cox’s Manager of Government Affairs, who expressed no objection to the continuance.
