TO: HONORABLE MAYOR AND COUNCILMEMBERS FROM: DIRECTOR OF PLANNING, BUILDING & CODE ENFORCEMENT DATE: OCTOBER 5, 2004 SUBJECT: AMENDMENT NO. 1 FOR CONTRACT TO PREPARE THE ENVIRONMENTAL IMPACT REPORT FOR THE POINT VIEW PROJECT (6001 PALOS VERDES DRIVE SOUTH) Staff Coordinator: Kit Fox, AICP, Senior Planner RECOMMENDATION Authorize the Mayor and the City Clerk to sign an amendment to the professional services agreement with PCR Services Corporation (PCR) in an amount not to exceed $38,980 to complete the preparation of an Environmental Impact Report (EIR) for the Point View project, located at 6001 Palos Verdes Drive South. BACKGROUND On July 15, 2003, the City Council approved a contract with PCR in the amount of $200,384 for the preparation of the Point View EIR. The draft EIR is currently nearing completion. However, due the high level of complexity of the project and other unanticipated factors, additional work beyond the original scope of the contract has been conducted or will be necessary to complete the EIR. Therefore, PCR has requested an amendment to the contract to cover this additional "out of scope" work. DISCUSSION The attached letter from PCR describes the "out of scope" work covered by the proposed contract amendment. Some of this work—specifically, additional air quality analysis and visual simulations—has already been completed by mutual agreement between Staff, PCR and the project proponent, totaling $11,020. Additional work, related mainly to the preparation of the soils and geology impact analysis, continues as the draft EIR nears completion. These services are expected to total $27,960. Staff, PCR and the project proponent agree that all of these services are necessary to complete the EIR. Therefore, the total contract amendment requested by PCR is $38,980. With respect to the status of the draft EIR itself, PCR has completed the preparation of many of the impact analysis sections and other portions of the draft document. Staff, PCR and the project proponent are working to complete the draft EIR—including some items covered by this contract amendment—for public release and comment this fall. CONCLUSION For the reasons noted above, Staff recommends that the City Council authorize the Mayor and the City Clerk to sign an amendment to the professional services agreement with PCR in an amount not to exceed $38,980 to complete the preparation of the EIR for the Point View project. ADDITIONAL INFORMATION The project applicant and PCR have been advised of the City Council’s consideration of this matter. In addition, Staff has notified a number of other parties who have previously expressed interested in this project. FISCAL IMPACT The amendment Point View EIR contract has no fiscal impact on the City since the cost of preparation for the EIR is borne by the project applicant, York Long Point Associates.
