SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING RESOLUTION 2004- 45, THE BUDGET APPROPRIATION FOR FY04- 05, TO INCREASE THE RPV TV CHANNEL 33 BUDGET FOR EQUIPMENT REPLACEMENT CHARGES
RECOMMENDATION
Adopt Resolution No. 2004- , amending Resolution No. 2004-45, the Budget Appropriation for FY04-05, to increase the RPV TV Channel 33 budget within the General Fund and the Telecom Equipment budget within the Equipment Replacement Fund.
BACKGROUND
At their August 31, 2004 meeting, the City Council approved an agreement with Cox Communications under which Cox will install a fiber optic connection from the Cox headend at the Peninsula Center to the City Studio along with a modulator at each end of the connection to create a working video and audio television connection between the Studio to enable direct broadcast onto Cox Channel 33
The equipment installed under the Agreement will be owned and controlled by the City. However, the City has agreed Cox will maintain and the City will fund the cost of maintaining the modulators and cable in a functional condition that will allow ongoing transmission of City programs on Channel 33. Cox will consult with the City regarding the cost of any repairs that exceed $1000. Invoices presented to the City for necessary repairs will be fully itemized.
DISCUSSION
The cost of installing the fiber optic connection and modulators will be approximately $41,500. The City has agreed to pay the cost of materials and installation up to this amount upon final testing of the system and acceptance by the City and presentation of an itemized invoice by Cox. In addition to the initial cost of the equipment an annual equipment replacement charge equal to 1/7 of the initial cost of the equipment ($5,930) will be included in the Channel 33 budget this year and for the succeeding seven years to maintain and replace the fiber optic cable and modulators.
FISCAL IMPACT:
The attached resolution authorizes an additional revenue and expenditure within the Equipment Replacement Fund resulting in a net impact of zero. Authorizing funds for the fiber optic connection will reduce the General Fund Reserves by $47,430 during the current fiscal year. A Statement of Estimated General Fund Reserves is attached for the Council’s information.

WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council: and
WHEREAS, on June 1, 2004, the City Council of the City of Rancho Palos Verdes adopted Resolution 2004-45, approving a spending plan and authorizing a budget appropriation for FY04-05; and
WHEREAS, the City Council wishes to fund the fiber optic cable and modulators to connect the RPV TV Channel 33 studio to the Cox Communications network and provide adequate funds to maintain and replace the cable and equipment.
BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:
