SUBJECT: VIEW RESTORATION PERMIT NO. 123 - APPEAL (APPLICANT: JIM AND LUCY WHITE, 28541 PALOS VERDES DRIVE EAST; FOLIAGE OWNERS: MR. JOHN ZACCARO, 28541 PALOS VERDES DRIVE EAST AND MR. AND. MRS. JIM MENJOU, 1 BRONCO DRIVE)

RECOMMENDATION:

Adopt Resolution No. 2004-__; denying the appeal, thereby affirming the decision of the Planning Commission and approving View Restoration Permit No. 123 upon finding that all applicable findings have been correctly made and all provisions of Section 17.02.040 have been complied with.

BACKGROUND

On October 5, 2004, the City Council opened the public hearing, accepted public testimony and agreed to conduct a site visit at the applicant and foliage owner’s properties to better access the concerns raised by both parties. On Saturday, November 13, 2004, the City Council conducted a site visit and continued the public hearing to November 16, 2004. At this time, Staff is recommending that City Council continue with its review and consideration of the appeal. A copy of the Staff Report presented to the City Council on October 5, 2004 is attached.
