SUBJECT: TRAFFIC SAFETY COMMISSION
Adopt Resolution No. A Resolution of the City Council of the City of Rancho Palos Verdes Disestablishing the Traffic Committee and Establishing a Traffic Safety Commission.
On November 18, 1975 the City Council established a Traffic Committee by adoption of Resolution No. 75-93. On February 16, 1993 the City Council adopted Resolution No. 93-9 that revised the Traffic Committee’s basic charter establishing the Committee’s purpose and duties. Finally, on February 21, 1995, the City Council adopted Resolution No. 95-17, once again amending the charter of the Traffic Committee.
At the City Council meeting of October 19, 2004 the City Council continued the matter of filling a vacant position on the Traffic Committee and appointed an Ad Hoc Committee of the Mayor and Mayor Pro Tem to meet with the City Manager to discuss a possible new charter for the Traffic Committee that would expand its duties and responsibilities.
At their meeting on November 16, 2004 the City Council approved a draft charter for a new Traffic Safety Commission and directed staff to prepare the necessary documents to formalize the new commission.
Mayor Gardiner and Mayor Pro Tem Clark met with me on October 25th to discuss the future of the Traffic Committee. The issues discussed included:
As a result of the discussion, the Mayor and Mayor Pro Tem asked the City Manager to prepare a new charter for a committee to be called the "Traffic Safety Commission" that would be consistent with the City Council’s tactical goal to formulate and implement a citywide traffic and parking plan. The proposed charter would also allow the Commission to be more proactive and assume broader responsibilities.
In addition to the expanded role of the new Commission, the Mayor and Mayor Pro Tem felt that:
At their November 16, 2004 meeting the City Council discussed a draft charter that included the Ad Hoc Committee recommendations and agreed that the new charter was appropriate if some additional wording were added that emphasized the need for the new Commission to be "proactive, originating and innovative"
Attached is the Resolution creating the new Commission. The existing Traffic Committee would continue to perform as usual until the Council formally appoints the new Commissioners.
No budget changes are required by the formation of the new commission.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DISESTABLISHING THE TRAFFIC COMMITTEE AND ESTABLISHING A TRAFFIC SAFETY COMMISSION
WHEREAS, on November 18, 1975, the City Council established a Traffic Committee with the adoption of Resolution No. 75-93;
WHEREAS, on February 16, 1993, the City Council adopted Resolution 93-9 which revised the basic charter which established the Traffic Committee’s purposes and duties.
WHEREAS, on February 21, 1995, the City Council adopted Resolution 95-17 establishing a Traffic Committee and amending Resolution 93-9
WHEREAS, the City Council wishes to disestablish the present Traffic Committee and create in its place a Traffic Safety Commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1. Traffic Safety Commission, Creation of. A Traffic Safety Commission is hereby established. It shall replace the existing Traffic Committee at such time as the City council formally appoints the Commissioners. It shall have the membership, responsibilities and duties as herein provided.
The Traffic Safety Commission shall serve as a citizen’s advisory board to the City Council on matters concerning Traffic Planning, Safety and Control. The Commission shall hear suggestions and concerns regarding Traffic Planning, Safety and Control, and shall make recommendations to the Council regarding these issues. The Commission shall consider other Traffic matters referred to it by the City Council, other City Commissions or Committees, Staff, the Los Angeles County Sheriff, Citizens or members of the Commissions and make appropriate recommendations or suggestions to the appropriate officials.
Section 2. Membership. The Commission shall be appointed by the City Council and shall consist of seven (7) members who should generally be representative of the various geographical areas of the City. The Chairperson shall be directly appointed by the City Council. The Commission may appoint a Vice-Chairperson from among its members.
The Director of Public Works shall act as advisor to this Commission. The Director or his designee shall attend the meetings of the Commission.
Section 3. Terms of Office. The membership shall serve terms of two (2) years in length. Each appointee’s term will expire on the date established by the City Council, or as soon thereafter as the vacancy is filled. The City Council may remove a member or members at any time for any reason.
Section 4. Meeting Time and Location. Regular meetings of the Commission shall be held at a regular time and location to be specified in the rules and regulations of the Commission. In general, meetings shall be held on a monthly basis. Special or adjourned meetings, if necessary, may be conducted in any manner provided by law.
Section 5. Duties. The Commission shall perform the following duties:
Section 6. Powers. The Commission is primarily an advisory body, but has certain specific responsibilities as described above under Duties. It shall have no power to direct or cause the expenditure of City funds except as specifically budgeted by the City Council. It shall have no power to take any action encumbering, conveying, or restricting the use of private or public property except as described above under Duties. It shall have no power to direct or review the operation of the Public Works Department, except as specifically described above under Duties, or as authorized by the City Council.
Section 7. Communications. The Commission is established by the City Council as a citizens advisory group, with certain specific duties, to enable the Council to more effectively administer the City and to respond to the citizenry.
The Commission is encouraged to formulate and forward alternative proposals to the City Council along with recommendations approved by the majority of the members of the Commission. Minority opinions of Commissioners, in written form, will be considered by the City Council before taking action on any recommendation of the Commission.
It is anticipated that the Commission will make recommendations to the Council through the Director of Public Works and the City Manager. The Commission shall, at all times, have direct access to the City Council through representation at regular City Council meetings, and in other manners as may be prescribed by the Council. The Commission may also request that the City Manager place items of concern on an appropriate City Council agenda.
Section 8. Support. The Director of Public Works shall serve as advisor to the Commission. He/She shall cause to be prepared such staff reports as may be necessary for the Commission to conduct its business. He/She shall provide administrative staff to take and publish Commission Meeting Minutes. He shall provide such other support as may normally be required by the Commission in the conduct of its business.
