SUBJECT: SECOND SYSTEM PERFORMANCE AUDIT OF 2000 CABLE TELEVISION FRANCHISE AGREEMENT

RECOMMENDATION

Continue Second Cable Television System Performance Audit to February 1, 2005.

BACKGROUND

The 2000 Cable Television Franchise Renewal Agreement allows for three system performance audits to be conducted following the second, fourth and sixth anniversary dates of the Agreement. October 17, 2004 marked the fourth anniversary of the Franchise Renewal Agreement. Pursuant to Section 8.1(b) of the Agreement, the City and Cox Communications are to meet within 90 days following the second anniversary date of the Agreement (by January 14, 2005) to review the performance of the cable television system. However, Art Yoon, Manager of Governmental Affairs for Cox Communications, has submitted a letter (see attached) requesting additional time to compile the required data for the audit. In light of the fact that the audit is already in progress and the additional time would improve the completeness and quality of the data submitted, staff has no objection to the requested continuance.
