TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DIRECTOR OF PLANNING, BUILDING AND CODE ENFORCEMENT DATE: AUGUST 17, 2004 SUBJECT: APPEAL OF THE CONDITIONS ON THE PLANNING COMMISSION’S APPROVAL OF A GRADING PERMIT (CASE NO. ZON2003-00088), FOR PROPERTY LOCATED AT 49¼ ROCKINGHORSE. (Applicant/Property Owner/Appellant – Stan Rinehart) Staff Coordinator: Dave Blumenthal, Associate Planner RECOMMENDATION Continue the Appeal of the Conditions of Approval for Grading Permit (Case No. ZON2003-00088) to the City Council meeting on November 2, 2004 DISCUSSION On May 25, 2004, the Planning Commission denied an appeal of the Director’s approval of a Grading Permit (Case No. ZON2003-00088), for property located at 49¼ Rockinghorse Road. As part of this action, the Planning Commission added a condition requiring the applicant to modify an existing ingress/egress easement, which extends across the property frontage. The applicant has since filed a timely appeal of this condition of approval. In an effort to come to a solution, the applicant would like additional time to work with the neighbors to resolve all of the outstanding issues. Accordingly, the applicant has requested that the City Council continue this item to the November 2, 2004 meeting.
