SUBJECT: CONFORMANCE WITH THE 2004 L.A. COUNTY CONGESTION MANAGEMENT PROGRAM (CMP)

Adopt Resolution No. 2004-__, thereby adopting the City's 2004 Local Development Report (LDR) and self-certifying the City's conformance with the 2004 Congestion Management Program (CMP) for Los Angeles County.
Staff is asking that the City Council adopt Resolution 2004-__, thereby adopting the City’s 2004 Local Development Report (LDR) and self-certifying the City’s conformance with the 2004 CMP. Staff believes that the City is in conformance with the 2004 CMP since the City is in conformance with all applicable requirements of the 2004 CMP and has taken all of the required actions of the Deficiency Plan.
A Congestion Management Program (CMP) was enacted by the State Legislature in 1990 to improve traffic congestion in California's urban areas. In accordance with the State statute, the Los Angeles County Metropolitan Transportation Authority (MTA) [previously known as the L.A. County Transportation Commission (LACTC)] adopted the first CMP for Los Angeles County on November 18, 1992.
In November 1993, the 1993 CMP was adopted by the MTA. In addition to providing refinements to the 1992 Program, the 1993 CMP added procedures for meeting Deficiency Plan requirements. The Deficiency Plan procedures are intended to address deficiencies projected to occur on the regional roadway network between 1990 and 2010. Since the CMP is a countywide program, all local jurisdictions must participate in the Deficiency Plan process, regardless of the number of CMP intersections or congestion levels within each City's limits.
The MTA has updated and adopted several Congestion Management Programs since 1993. Most recently, the MTA adopted the 2004 CMP. The 2004 CMP summarizes the results from nine years of highway monitoring, eight years of local growth monitoring, and thirteen years of local transportation improvements. In addition, the 2004 Program modified the local responsibilities by suspending the requirements for maintaining a positive credit balance. In past years, each local jurisdiction’s Congestion Management efforts were tracked by a point system that reflected the impact of local growth (debits) and benefits of transportation improvements (credits). The object was to maintain a positive credit balance. Due to concerns raised by cities, in August 2003, the MTA Board authorized a nexus study to evaluate the feasibility of implementing a congestion mitigation fee to meet CMP Deficiency Plan requirements. While this study is underway, CMP Deficiency Plan requirements for maintaining a positive credit balance have been suspended. However, reporting on all new development activity and adopting a self-certification resolution is still required.
In accordance with the 2004 CMP, the purpose of this agenda item is for the City Council to adopt the attached self-certification conformance resolution, thereby adopting the City's 2004 LDR and self-certifying the City's conformance with the CMP requirements. The LDR is a reporting form, which calls for information on new net development in our City. The City’s 2004 LDR is attached to the staff report. Upon adoption, the adopted resolution and 2004 LDR will be transmitted to the MTA for its review and approval.
In adopting the attached self-certification resolution, the City resolves that it is in conformance with all the applicable requirements of the 2004 CMP and has taken, or will take, each of the following four specific actions (the requisite action appears in bold type and the City's response in normal type):
In 2003, the City’s Public Works Department transmitted to the MTA the results of the 2003 highway monitoring performed on Western Avenue, in accordance with the requirements of the CMP. This year there is no local highway monitoring required.
On February 2, 1993, the City Council adopted the required TDM Ordinance (Municipal Code Chapter 10.28) and Staff continues to implement the TDM Ordinance, where applicable. As part of the Development Code Amendment proceedings, completed in May 1997, the TDM Ordinance was incorporated into the Development Code by reference.
On July 6, 1993, the City Council adopted an amended set of Local CEQA Guidelines, which incorporated the County's CMP Land Use Analysis program into the City's environmental review procedures. City Staff continues to implement the land use analysis program where applicable.
As stated above, the 2004 CMP local jurisdiction responsibility is to report the 2003/2004 new development activities. For purposes of the 2004 Local Development Report (LDR), the City tracked new development activity for the time period between June 1, 2003 and May 31, 2004. During this period, final building permits were issued for 15 new residential dwelling units and two permits were issued for the demolition of two dwelling units. This results in a net increase of 13 new dwelling units. For comparison, last year there was an increase of 6 new dwelling units.
In accordance with the Deficiency Plan of the 2004 CMP, the City Council, through a noticed public hearing, must adopt a self-certification conformance resolution, whereby the City agrees to conform to the local responsibilities required by the 2004 CMP, including preparation of the 2004 LDR. As documented in this Staff Report, the City is in conformance with all applicable requirements of the 2004 CMP and has taken all of the required actions of the Deficiency Plan. Therefore, Staff recommends that the City Council adopt the attached Resolution No. 2004 - __ and authorize the City Clerk to forward this document to the MTA.

RESOLUTION NO. 2004-__
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089.
WHEREAS, CMP statute requires the Los Angeles County Metropolitan Transportation Authority ("MTA"), acting as the Congestion Management Agency for Los Angeles County, to annually determine that the County and cities within the County are conforming to all CMP requirements; and
WHEREAS, MTA requires submittal of the CMP Local Development Report by September 1 of each year; and
WHEREAS, the City Council held a noticed public hearing on August 17, 2004, at which time all interested parties were allowed to attend and give testimony.
NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the City of Rancho Palos Verdes ("City") has taken all of the following actions, and that the City is in conformance with all applicable requirements of the Draft 2004 CMP issued on January 9, 2004.
By June 15, of odd-numbered years, the City will conduct annual traffic counts and calculated levels of service for selected arterial intersections, consistent with the requirements identified in the CMP Highway and Roadway System chapter.
The City has locally adopted and continues to implement a transportation demand management ordinance, consistent with the minimum requirements identified in the CMP Transportation Demand Management chapter.
The City has locally adopted and continues to implement a land use analysis program, consistent with the minimum requirements identified in the CMP Land Use Analysis Program chapter.
The City has adopted a Local Development Report, attached hereto as Exhibit "A" and made a part hereof, consistent with the requirements identified in the Draft 2004 CMP. This report balances traffic congestion impacts due to growth within the City with transportation improvements, and demonstrates that the City is meeting its responsibilities under the Countywide Deficiency Plan consistent with the MTA Board adopted 2003 Short Range Transportation Plan.
SECTION 2. That the City Clerk shall certify to the adoption of this Resolution and shall forward a copy of this Resolution to the Los Angeles County Metropolitan Transportation Authority.
