SUBJECT: RUBBERIZED ASPHALT CONCRETE GRANT FY 04-05

RECOMMENDATION
BACKGROUND AND DISCUSSION
The California Integrated Waste Management Board (CIWMB) administers the tire grant programs, SB 1346, and provides opportunities to divert waste tires from landfill disposal, prevents illegal tire dumping, and promotes markets for recycled-content tire products. In FY 04-05 the amount of $1,200,000 will be available for the rubberized asphalt concrete (RAC) grants. Eligible applicants may request grant funding from $6,250 to $50,000 for eligible projects. The City plans to use rubberized asphalt concrete in the upcoming arterial overlay project. This is a grant eligible activity. In the past, RAC has been successfully used in RPV on similar projects. In FY 03-04, the City received a grant in the amount of $8,300 for the use of approximately 7,000 tons of RAC as part of the City's arterial overlay project on Hawthorne Blvd. and Crenshaw Blvd.
The grant application and Resolution No. 2005- __ must be submitted by January 14, 2005. If the City receives the grant, it will offset expenditures in Capital Improvement Project (CIP) fund. Staff time for administering the grant will be absorbed by the Waste Reduction fund.
ALTERNATIVE
The alternative would be to not submit a grant application. No funding will be received if the alternative is approved.
FISCAL IMPACT
If approved, the City may receive a grant in FY 04-05 for the use of RAC on the City's arterial overlay project. There is a maximum grant of up to $50,000 per applicant. If the grant is awarded, the exact amount will depend on the CIWMB and will help offset budgeted expenditures in the CIP fund.

RESOLUTION 2005-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING STAFF TO SUBMIT AN APPLICATION FOR THE SB 1346 RUBBERIZED ASPHALT CONCRETE GRANT PROGRAM
WHEREAS, Public Resources Code Section (PRC) 42872, authorizes the California Integrated Waste Management Board (CIWMB) to establish a grant program to provide opportunities to divert waste tires from landfill disposal, prevent illegal tire dumping, and to promote markets for recycled-content waste tire products; and
WHEREAS, the CIWMB has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by individuals, businesses, and research institutions under the program; and
WHEREAS, said procedures established by the CIWMB require the applicant to certify, by resolution, approval of the application before submission of said application to the State; and
WHEREAS, if awarded a grant, the applicant will enter into an agreement with the State of California for development of the project;
BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:
That the City Council authorizes the submittal of an application to the CIWMB for an SB 1346 Rubberized Asphalt Concrete Grant. The Director of Public Works, is hereby authorized and empowered to execute in the name of the City of Rancho Palos Verdes all necessary applications, contracts, agreements, amendments, and payment requests hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
