1. Motion to waive full reading

Recommendation: Adopt a motion to waive reading in full of all ordinances presented at this meeting with consent of the waiver of reading deemed to be given by all Council Members after the reading of the title.

  1. Extension of the Affordable Housing Developer Fee Program for an Additional Five (5) Years (Fox)

Recommendation: ADOPT RESOLUTION NO. 2005- , MAKING CERTAIN FINDINGS TO EXTEND THE AFFORDABLE HOUSING DEVELOPER FEE PROGRAM AND RETAIN THE FEES THAT WERE DEPOSITED INTO THE PROGRAM FOR AN ADDITIONAL FIVE (5) YEARS.

3. Confirmation of the Appointment of a City Delegate and Alternates to the Governing Board of the South Bay Cities Council of Governments (Petru)

Recommendation: ADOPT RESOLUTION NO. 2005 - ; CONFIRMING THE APPOINTMENT OF A DELEGATE, PRIMARY ALTERNATE AND SECONDARY ALTERNATES TO THE GOVERNING BOARD OF THE SOUTH BAY CITIES COUNCIL OF GOVERNMENTS (A JOINT POWERS AUTHORITY).

4. Claim Against the City by Jeffery Brown (Park)

Recommendation: Reject the claim and direct staff to notify the claimant.

5. Claim Against the City by Daniel Pantucci (Park)

Recommendation: Reject the claim and direct staff to notify the claimant.

6. Claim Against the City by Charles Brumbaugh (Park)

Recommendation: Reject the claim and direct staff to notify the claimant.

7. Claims Against the City by Indian Ridgecrest Gardens, LP (Park)

Recommendation: Reject the claims and direct staff to notify the claimant.

8. Repair of the Tarapaca Storm Drain (Allison)

Recommendation: Review and reconfirm a four/ fifths (4/5s) vote, the Council’s action on December 21, 2004, to authorize staff to conduct an informal bid process to repair the Tarapaca Storm Drain.

9. Repair of the Western Avenue Storm Drain (Allison)

Recommendation: Review and reconfirm a four/ fifths (4/5s) vote, the Council’s action on January 4, 2005. An emergency exists which will not permit a delay from a competitive solicitation for bids and that the actions taken are necessary to respond to the emergency.

10. On Call Service Providers (Allison)

Recommendation: 1) Award a contract for on call professional services for FY 04 – 05, and FY 05 – 06 to RBF Consultants, Berryman and Henigar and Associates, Kleinfelder Consultants Inc., Lenocker & Associates, Inc. KEC Consultants, Inc., Peter Gambino and Associates, Inc., and David Volz Design; and, 2) Authorize the expenditures with these firms in accordance with City Council established guidelines for on-call professional services, and the adopted budgets for FY 04 – 05 and FY 05 – 06.    

  1. Award of Professional Services Contract For Engineering Services Regarding Proposed Water Quality And Flood Protection Program (McLean)

Recommendation: Approve the attached Professional Services Agreement for engineering services with Harris & Associates for services associated with finalizing the rate analysis for the proposed Water Quality and Flood Protection Program for an amount "not to exceed" $23,000.

12. Award of Professional Services Contract For Public Information Services Regarding Proposed Water Quality And Flood Protection Program (McLean)

Recommendation: Approve the attached Professional Services Agreement with Moore Iacofano Goltsman, Inc. for public information consulting services regarding the proposed Water Quality and Flood Protection Program and other de-minus services for an amount "not to exceed" $61,500.

13. Register of Demands (McLean)

Recommendation: ADOPT RESOL. NO. 2005- , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID.

(30 min) 14. 2004 Five-Year Financial Model – Revision 2 (McLean)

Recommendation: 1) Receive and file the 2004 Five-Year Financial Model - Revision 2 (the "2004 Model"); and, 2) ADOPT RESOLUTION NO. 2005- , AMENDING RESOLUTION NO. 2004-45, APPROVING THE CITY’S BUDGET FOR FY04-05, TO INCREASE GENERAL FUND REVENUES IN THE AMOUNT OF $2,214,677, BASED UPON AN INCREASE OF $1,539,157 FOR PROPERTY TAX IN-LIEU OF VLF, A DECREASE OF GENERAL FUND REVENUES IN THE AMOUNT OF $165,000 FOR GOLF TAX REVENUE AND AN INCREASE IN GENERAL FUND REVENUES IN THE AMOUNT OF $840,520 RESULTING FROM THE SALE OF THE TYLER PROPERTY.

(20 min) 15. Portuguese Bend Nature Preserve Naming Opportunities (Rojas)

Recommendation: 1) Approve the concept of allowing portions of the proposed City-owned Portuguese Bend Preserve to be named after donors who make monetary contributions toward acquisition of the privately owned parcels that will make up the Preserve; and, 2) Approve the concept of allowing a portion of Del Cerro Park to serve as a donor recognition site.

Recommendation: Consider a financial contribution to the Los Angeles Air Force Base Regional Alliance.

(10 min) 17. Blue Star Program (Evans)

Recommendation: Consider adopting a program to honor military families who live on the Peninsula.

(10 min) 18. Budget Review Sessions and Community Leaders’ Breakfast Schedule for 2005 (Petru)

Recommendation: 1) Select two dates in May for the Budget Review Sessions; and, 2) Select two dates, one in spring and one in fall, for the Community Leaders' Breakfast meetings.

ANTICIPATED LITIGATION

Pursuant to Sections 54956.9(b) and (c) of the California Government Code, the City Council is meeting in closed session to discuss potential litigation against the City and potential litigation by the City against other parties arising from the sinkhole on Western Avenue.

Pursuant to Section 54956.9(b) of the California Government Code, the City Council is meeting in closed session to discuss potential litigation, due to a threat of a lawsuit being filed by John Simich, property owner at 7460 Alida Place. Said threat made during an April 20, 2004 telephone conversation with Public Works Director Dean Allison.
