SUBJECT: NOTICE OF COMPLETION FOR THE FY 2002-2003 RESIDENTIAL STREET OVERLAY AND SLURRY SEAL PROJECT

RECOMMENDATION:

1. Accept the work as complete; and

2. Authorize the City Clerk to file a Notice of Completion with the County Recorder; and if no claims are filed within 35 days after recordation, and upon the contractor posting an acceptable warranty bond, notice the surety company to exonerate the Payment and Performance bonds; and

3. Authorize the Director of Public works to release the 10% retention payment, to Sequel Contractors, Inc., 35 days after recordation of the Notice of Completion by the County Recorder contingent upon no claims being filed on the project, and the contractor posting an acceptable warranty bond.

BACKGROUND & ANALYSIS

The project consisted of resurfacing various residential streets in the zone 1 maintenance area (see attached map). The contract for the project was awarded to Sequel Contractors, Inc. on May 4, 2004. Since that time, all work has been satisfactorily completed.

The final project costs are as follows:

The total construction cost is greater than the award amount but less than the total authorized budget. Additional work items consisting of striping, utility relocation, and curb and gutter repairs were added to the contract.

FISCAL IMPACT

The recommended action will have no fiscal impact. This project was budgeted in the Capital Improvement Program (CIP) Fund and Gas Tax fund.

CONCLUSION

Sequel Contractor, Inc. has successfully completed all work in accordance with the plans and specifications. Therefore, the work should be accepted as complete and a Notice of Completion filed.
