SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING RESOLUTION 2004- 45, THE BUDGET APPROPRIATION FOR FY04- 05, TO INCREASE THE RPV TV CHANNEL 33 BUDGET FOR MEMBERSHIPS AND DUES
(1) Adopt Resolution No. Amending the 2004-05 Budget by Appropriating Funds in the Amount of $1010 for membership in NATOA and $25 for membership in SCAN NATOA; (2) Appoint NATOA representatives.
NATOA stands for National Association of Television Officers and Advisors. It is an organization of PEG providers joined together to provide Community Access Programs to the public and generally consists of municipalities. In July 2004, the City Council authorized $475 for the 2004 membership in NATOA.
SCAN NATOA is the States of California and Nevada Television Officers and Advisors and is a subsidiary of NATOA. In July 2004, the City Council authorized $25 for membership in this organization.
Ms. Holt attended the 2004 SCAN NATOA conference in Santa Monica. She reported that the major cities were present at the meeting and discussed all sorts of "issues" with their cable providers including use of the public right of way, telecommunications issues and future court decisions. NATOA is interested in protecting local government's right to manage their rights of way and supported Rancho Palos Verdes in the Abrams case.
Although the City is still in the 2004-05 fiscal year, NATOA operates on a calendar year and annual dues are now payable. The cost of membership this year is $510. In addition, there is an Assessment for the NATOA Legislative/Regulatory fund of $500. Mayor Gardiner and Ms. Holt feel it would be beneficial for the City to continue to participate in the NATOA organization.
The NATOA membership allows the governing agency to name (3) individuals who represent the agency during the membership. Only (1) of those members can cast a vote at the annual NATOA meeting regarding operations of NATOA, and the vote represents the view of the representative governing agency. Ms. Holt, who represented the City last year thinks having two City Council members (perhaps from the Cable TV Committee) named as members would be very beneficial. The third member (Ms. Holt or Ted Vegvari) could represent the City as "staff" and should be willing to attend the conferences, and
participate in the SCAN NATOA local meetings as well.
Authorizing funds for the membership in NATOA will reduce the General Fund Reserves by $1,035 during the current fiscal year. A Statement of Estimated General Fund Reserves is attached for the Councilís information.

WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council: and
WHEREAS, on June 1, 2004, the City Council of the City of Rancho Palos Verdes adopted Resolution 2004-45, approving a spending plan and authorizing a budget appropriation for FY04-05; and
WHEREAS, the City Council wishes to fund membership in the National Association of Telecommunications Officers and Advisors;
BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:
The following adjustments be made to the FY04-05 budget:
Increase the General fund budget as follows:
RPV TV Channel 33 101-1006-411.59-2 Membership and Dues $1,035
