SUBJECT: CLAIM AGAINST THE CITY BY RICHARD AND LISA CARL
RECOMMENDATION
Reject the claim and direct staff to notify the claimant.
BACKGROUND/DISCUSSION
The claimant alleges personal and real property at 42 Sea Cove Drive sustained flood related damages during heavy rainstorms on February 19, 2005. The claimant alleges the flooding was allegedly caused by public agency’s negligence and existing dangerous conditions of public property. The claim for damages in an amount not less than $3,600,000. A copy of the claim is attached.
The City’s Claims Administrator, Carl Warren and Company, has advised the City to reject the claim.
