SUBJECT: VACATION OF CITY RIGHT OF WAY AT NANTASKET DRIVE
RECOMMENDATION
Provide direction to staff as to if the City should proceed with the request
to vacate right of way over a parcel on Nantasket Drive.
BACKGROUND
The City is in receipt of an application for a zone change for a property along Nantasket Drive. The applicant has indicated that if the zone change is allowed to move forward he would also be requesting the City consider a request to vacate two easements over that same property.
City Council Resolution 90-93 establishes the procedure for vacation requests. According to that resolution upon receipt of a request, the City Council shall make a determination as to if the City should consider the request. If the City Council agrees to proceed with the request the resolution requires the applicant to establish a trust deposit to fund city costs related to the vacation.
DISCUSSIONS
The parcel in question and city easements are shown on the attached exhibit. The easements are dedicated to several public agencies, including the City, for street and other public purposes.
Staff has made no conclusions regarding the merits of the vacation application, however, if the City Council elects to begin the zone change process staff recommends that we accept the request for vacation, establish a trust deposit, to fund a staff investigation into the merits of the request.
FISCAL IMPACT
The recommended action has no fiscal impact. All city costs related to a vacation request is borne by the applicant.
