RECOMMENDATIONS
Review and reconfirm by four/fifths (4/5) vote, the Council’s previous action on October 18, 2005 to authorize staff to conduct an informal bid process to construct interim improvements to Barkentine/Sea Cove and other miscellaneous drainage improvements.
BACKGROUND
On October 18, 2005, the City Council found that an emergency exists concerning the construction of interim improvements to Barkentine/Seacove and other miscellaneous drainage improvements. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to construct these improvements.
DISCUSSION
Approval of both the informal bid process, the construction plans and the negotiation and execution of the construction contract with the City’s on-call Roadway Maintenance Contractor, Hardy & Harper Inc., staking and inspection services with the City’s on-call Engineering Consultant, KEC Engineers Inc. and the expenditure of $360,000 for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review this action and reaffirm it by a four-fifths (4/5) vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because to date only two of the five improvements have been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until all five projects are completed.
