SUBJECT: REPAIR OF THE TARAPACA STORM DRAIN
RECOMMENDATION
Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on December 21, 2004 to authorize staff to conduct an informal bid process to repair the Tarapaca Storm Drain.
BACKGROUND
On December 21, 2004, the City Council found that an emergency exists concerning the repair of the Tarapaca Storm Drain. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to line the existing pipe.
DISCUSSION
Approval of both the informal bid process, the pre-ordering of the pipe and the negotiation and execution of the construction contract with the City’s on-call Roadway Maintenance Contractor, Hardy & Harper Inc., and the expenditure of the $95,000 for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1).
In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the repair has not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until the project is completed.
CURRENT STATUS
The Contractor is continuing his work on the hillside behind the homes on Tarapaca Drive. The hand excavation of slope anchors has been completed and wooden concrete forms erected.
Week Activity
November 7 Concrete to be placed in the slope anchor forms.
November 14 New pipe to be installed on the slope extending into the canyon.
November 21 Outlet structure to be constructed following installation of the pipe.
