SUBJECT: INTERIM IMPROVEMENTS TO BARKENTINE/SEA COVE AND OTHER MISCELLANEOUS DRAINAGE IMPROVEMENTS

Review and reconfirm by four/fifths (4/5) vote, the Council’s previous actions on October 18 and November 1, 2005 to authorize staff to conduct an informal bid process to construct interim improvements to Barkentine/Sea Cove and other miscellaneous drainage improvements.
On October 18 and November 1, 2005, the City Council found that an emergency exists concerning the construction of interim improvements to Barkentine/Seacove and other miscellaneous drainage improvements. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to construct these improvements.
Approval of both the informal bid process, the construction plans and the negotiation and execution of the construction contract with the City’s on-call Roadway Maintenance Contractor, Hardy & Harper Inc., staking and inspection services with the City’s on-call Engineering Consultant, KEC Engineers Inc. and the expenditure of $295,000 (which includes $20,000 for construction contingencies and $13,900 for construction staking/inspection) for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review this action and reaffirm it by a four-fifths (4/5) vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because at the time of writing this report, only two of the five improvements have been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until all five projects are completed.
The following is a brief description of these storm drain improvement projects and their current status:

involving the construction of a new 18" storm drain Tentative

Miscellaneous Drainage Improvements:
north side of Palos Verdes Drive South (east of Crestmont) Tentative
by constructing a new concrete apron and rip rap together Construction
with two wing walls at slope toe. Estimated Const. Cost: $24,500 Start Date: Nov. 21
At 30502 Palos Verdes Drive West by creating a curb complete (See
opening. Actual Const. Cost: $8,600 Exhibit A).
Drive East involving the construction of a new 18" storm started Nov. 7
drain lateral and 2 new catch basins on Bronco Drive and Tentative
the creation of a pavement crown on Bronco between PVDE Completion

Adopting the staff recommendation will authorize staff and the City’s existing On-Call Roadway Maintenance Contractor, Hardy and Harper Inc., to continue with the construction of these urgently needed repairs/improvements (as originally authorized at the October 18 City Council meeting) before the onset of the rainy season this winter.
