TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DIRECTOR OF PUBLIC WORKS DATE: DECEMBER 20, 2005 SUBJECT: PONTEVEDRA EMERGENCY STORM DRAIN REPAIRS Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on December 6, 2005 to authorize staff to conduct an informal bid process to repair the Pontevedra storm drain line. BACKGROUND On December 6, 2005, the City Council found that an emergency exists concerning the repair of the Pontevedra Storm Drain line. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to line the existing pipe. DISCUSSION Approvals of the informal bid process, the pre-ordering of materials, the negotiation and execution of the $100,000 construction contract with Peterson-Chase, General Engineering Construction, Inc., and the $20,000 professional services agreement with PSOMAS required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the repair has not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until the project is completed. CURRENT STATUS Contracts have been provided to Peterson-Chase and PSOMAS. At the time this report was written the required bonds, insurance and signed contract had not been received from Peterson-Chase or PSOMAS. Both are expected soon. Staff met with the contractor, Caltrans, PSOMAS and others on December 8th to discuss the project and establish a tentative schedule for the work (presented below). The first order of work will be to evaluate the stability of the slope adjacent to Western Ave. Week Activity Lining the Pontevedra storm drain line will be performed following rehabilitation of the pipe. This work is being performed under a separate contract. Staff anticipates the repairs to the pipe and the lining will be completed by mid January 2006.
