FROM: DIRECTOR OF PUBLIC WORKS DATE: JANUARY 17, 2006 SUBJECT: REPAIR OF THE TARAPACA STORM DRAIN Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on December 21, 2004 to authorize staff to conduct an informal bid process to repair the Tarapaca Storm Drain. BACKGROUND On December 21, 2004, the City Council found that an emergency exists concerning the repair of the Tarapaca Storm Drain. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to line the existing pipe. DISCUSSION Approval of both the informal bid process, the pre-ordering of the pipe and the negotiation and execution of the construction contract with the City’s on-call Roadway Maintenance Contractor, Hardy & Harper Inc., and the expenditure of the $95,000 for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the repair has not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until the project is completed. CURRENT STATUS The Contractor has completed the outlet structure and has ordered fabrication of the pipe to accommodate the special installation requirements of this job. Delivery of the pipe is scheduled for January 18 and the installation completed by Friday January 20. The site will be cleaned up the following week.
