PORTION OF EASTVIEW PARK AS A WESTERN AVE PROJECT STAGING AREA

RECOMMENDATION
Approve request from County Sanitation Districts of Los Angeles County for an occupational right of way to utilize an undeveloped portion of Eastview Park for a Western Avenue Pumping Plan Modifications Project construction staging area.

BACKGROUND:
The County Sanitation District #2 of Los Angles County is preparing to update and expand the existing pumping plant located at the intersection of Western Avenue and Avenida Aprenda. The Santiation District is proposing to use a portion of Eastview Park for a construction staging area during this project from February 2006 to August 2007. Eastview Park is owned by the Sanitation District and has been leased to the City since September 20, 1989.

DISCUSSION:
The approximately 8000 square foot part of Eastview Park proposed for use by the Sanitation District is located behind the existing parking lot in an undeveloped portion of the park (see attached map). The District is proposing blocking off 2-3 parking spaces located directly in front of an existing driveway to ensure regular access to the staging area. Proposed access hours to the site are 7am-4pm Monday to Friday. The District anticipates that the contractor will need to access the staging area at night between the hours of 10pm-5am for two consecutive nights on at least two occasions. This is due to lane closures on Western for the purpose of installing sewer lines and manholes, which, due to Caltrans restrictions, must take place at night.

According to the District proposal, the staging area will be used to store equipment, including excavation equipment and trucks, and materials including dirt, piping, steel, lumber and concrete forms. The area will be fenced and secured by the contractor. The District has requested that a dumpster and piles of wood chips and debris, currently on site, be removed from the requested area by the City. The proposal calls for the Sanitation District to return the site to its original condition at the conclusion of the project. The District agrees to indemnify and hold harmless the City during the project and to discount the City’s rent based upon the area impacted and the time the staging area is occupied by the District. The District is willing to notify any residents, businesses, or HOAs that the City stipulates.

FISCAL IMPACT:
The current lease rate is $.004 per square foot per year for the total 10.67 acre Eastview site. Eastview’s 2005 lease amount was $1824.00. The 2006 lease amount, after adjusting for a CPI increase, would be reduced by approximately $32 for the 8000 square feet staging area.
