SUBJECT: NOTICE OF COMPLETION FOR IMPROVEMENTS TO THE POINT VICENTE INTERPRETIVE CENTER EXPANSION PROJECT

RECOMMENDATIONS

1. Accept the work done by MTM Construction Inc. on the construction of the Point Vicente Interpretive Center Expansion Project, as completed
2. Authorize the City Clerk to accept the amount of $10,000 to be held for a period of 90 days after the filing of the Notice of Completion as a performance surety for the trouble free operation of the window shutters for that period.
3. Authorize the City Clerk to file the attached Notice of Completion with the Los Angeles County Recorder; and if no claims are filed within 35 days of recordation of the Notice, City Clerk shall notify MTM Construction, Inc. to exonerate both the Payment and Performance Bonds.
4. Authorize the City Clerk to accept the attached Maintenance Bond in the amount of $4,013,420, issued by CNA / Western Surety Company of Woodland Hills, CA 91367 which will remain in force for a period of one (1) year after the date of Notice of Completion and acceptance.
5. Authorize the Director of Public Works to release the 10% retention payment to MTM Construction, Inc. less $10,000 noted in item #2 above, 35 days after recordation of the Notice of Completion by the City Clerk at the Los Angeles County Recorder’s office, contingent on no claims being filed against the project.

BACKGROUND

On July 13, 2004, the City Council awarded a construction contract to MTM Construction, Inc., for the construction of the Point Vicente Interpretive Center Expansion Project. The authorized construction budget for this project was
$4,013,420.00, plus the amount of $401,342.00 for a contingency.

On November 1, 2005 the City council authorized expenditure of an additional
$92,576.00 to add to the construction contingency. The funds for this were allocated from the following sources: $75,184.00 from Parks and Recreation for work undertaken on their behalf and $17,392.00 from money left over from the budget for asbestos abatement on the existing PVIC building.

The construction of the Point Vicente Interpretive Center Expansion Project was completed on February 28, 2006 at a cost of $4,502,489.44 as summarized below:

CONCLUSION

MTM Construction Inc. has successfully completed all work in accordance with the contract documents. Therefore, the work should be accepted as complete and the attached Notice of Completion filed.

 

FISCAL IMPACT

Funding for this project was approved at the July 13, 2004 City Council meeting and a further expenditure authorized on November 1, 2005. The project was completed within the approved amounts with a balance of $4,898.56 remaining.
