SUBJECT: NOTICE OF COMPLETION FOR THE INTERIM IMPROVEMENTS TO BARKENTINE/SEA COVE AND OTHER MISCELLANEOUS DRAINAGE IMPROVEMENTS

RECOMMENDATIONS

1. Accept the work as complete.

2. Authorize the City Clerk to file a Notice of Completion with the County Recorder; and if no claims are filed within 35 days after recordation;

3. Authorize the director of Public Works to release the 10% retention payment, to Hardy & Harper, Inc., Construction Company 35 days after recordation of the Notice of Completion by the County Recorder contingent upon no claims being filed on the project.

BACKGROUND

On October 18, 2005, the City Council found that an emergency exists concerning the construction of interim improvements to Barkentine/Seacove and other miscellaneous drainage improvements. Accordingly, the City Council approved the execution of a construction contract with the City’s on-call Roadway Maintenance Contractor, Hardy & Harper, Inc. to accomplish this work.

DISCUSSION

Updates specific to the improvements have been provided at each City Council meeting since approval of the emergency repairs in accordance with Public Contract Code Section 22050 (a)(1) and 22050 (c)(1).

CURRENT STATUS

The contractor has completed all work associated with the emergency repairs.

The final project costs are as follows:

Total Amount Approved: $300,000.00

Barkentine/Seacove Interim Improvements $107,079.85
Modify Structure on P.V. Drive South 26.000.00
Modify Catch Basin P.V. Drive West 8,600.00
Bronco Drive Improvements 66,000.00
Noble View Canyon Improvements 27,000.00
Total Construction Costs: $234,679.00

Hardy & Harper, Inc. has successfully completed all required work associated with the interim improvements. Therefore, the work should be accepted as complete and a Notice of Completion filed.
