TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: DIRECTOR OF PUBLIC WORKS DATE: JUNE 6, 2006 SUBJECT: PONTEVEDRA EMERGENCY STORM DRAIN REPAIRS RECOMMENDATION Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on December 6, 2005 to authorize staff to conduct an informal bid process to repair the Pontevedra storm drain line. BACKGROUND On December 6, 2005, the City Council found that an emergency exists concerning the repair of the Pontevedra Storm Drain line. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to line the existing pipe. DISCUSSION Approvals of the informal bid process, the pre-ordering of materials, the negotiation and execution of the $100,000 construction contract with Peterson-Chase, General Engineering Construction, Inc., and the $20,000 professional services agreement with PSOMAS required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the requirements of the contract have not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until all aspects of the contract are completed. CURRENT STATUS Contracts were executed with Peterson-Chase (construction Contractor) and PSOMAS (project Inspector) in December 2005. All construction work associated with repairing the storm drain line on Pontevedra Dr., from the manhole adjacent to 28408 Pontevedra Dr. on the west extending easterly within an easement and terminating within the State Right of Way on Western Ave, has been completed. Staff has reviewed the final construction related costs. Upon final review and approval of the acceptable costs at the state level, staff will recommend acceptance of the work.
