SUBJECT: CLAIM AGAINST THE CITY BY CAROLE ROBERTS AND ELBA GUENTHER

RECOMMENDATION
Reject claim and notify claimants.

BACKGROUND/DISCUSSION
Claimants allege city storm drains blocked by debris and an earthen berm near the alley drain caused flooding of business property at 32-34 Miraleste Plaza on January 2-3, 2006. The claim amount is $1,118 for carpet repairs. A copy of the claim is attached.

The City’s Claims Administrator, Carl Warren & Company, has advised the City to reject the claim. The Claimants’ representative has been notified by phone and in writing the conclusion of the claim investigation. The Miraleste Recreation District recent grading improvements on their property located adjacent to the claimants’ property and newly constructed berm diverted some rainwater run-off into Miraleste Plaza. Miraleste Recreation District is a separate entity from the City of Rancho Palos Verdes and is not owned, maintained or controlled by the City of Rancho Palos Verdes. Carl Warren & Company recommended that the claimants pursue their claim damages with Miraleste Recreation District.
