SUBJECT: CLAIMANT MARON’S APPLICATION FOR LEAVE TO PRESENT A LATE CLAIM
RECOMMENDATION
Reject the claimant’s application for leave to present a late claim and direct staff to notify the claimant.
BACKGROUND/DISCUSSION
The claimant, Eglantina Maron, filed a claim against the City on April 27, 2006 alleging the City incorrectly permitted her neighbor’s drainage system (25 Mustang), which became over-loaded and caused a slope failure at her residence (6 Bronco Drive) on December 28, 2004. The City then returned the claim because it was not presented within six months after the occurrence of the alleged damage as required by law. In response to the City’s late claim notice, the claimant applied via e-mail to the City Council for leave to present a late claim. The City’s Claim Administrator, Carl Warren & Company, has advised the City to reject the claimant’s application for leave to present a late claim.
