SUBJECT: AMEND JOINT POWERS AGREEMENT FOR DISASTER MANAGEMENT
1. Adopt Resolution No. 2006-XX, adopting the Area G Joint Powers Authority Agreement amendment, which authorizes the Office of Disaster Management Area G to create pre-disaster purchase agreements on behalf of the Area G Cities, and
2. Authorize the City Manager to sign the addendum on behalf of the City.
Last fall, in the aftermath of Hurricane Katrina, the rapid provision of critical disaster assistance from higher levels of government was inadequate to meet the immediate needs of the affected communities in the Gulf Coast region. There are many reasons why this happened, but the key issue is that it did happen, and in a major disaster in Southern California, it would likely happen again. One of the steps that can be taken to deal with this problem is to have pre-existing agreements with vendors of critical supplies for disaster response activities.
The adoption of this addendum to the Area G Joint Powers Authority Agreement will provide the mechanism for the Office of Disaster Management, Area G to create pre-existing agreements with key vendors of heavy equipment, electrical generators, food, water, fuel and other supplies and equipment needed for a prompt and effective response to a major disaster. The creation of these agreements in advance of a disaster will in no way obligate the Area G cities to rent or purchase any equipment or supplies at any time. The agreements will simply provide a mechanism by which a city may choose to obtain essential equipment or supplies if they are needed during a disaster.
This proposal of establishing “on-call” agreements is different from the Council’s approved project for Pre-Positioned Emergency Supplies and Equipment in storage containers around the City. The pre-positioned supplies are intended to serve the immediate, critical needs of the City’s EOC (Emergency Operations Center) within 24-72 hours after a disaster incident. The “on-call” purchase/rental agreements are intended to secure massive quantities of supplies and equipment for the City EOC and the public for a longer duration until state or federal assistance arrives.
Having a list of pre-designated potential suppliers will speed up the process of getting emergency supplies when needed to the general public and for city emergency operations. Cities may use these agreements at their complete discretion. The use of a pre-existing agreement by one city will in no way obligate any other city to participate. Each city will be independent of the others, but all Area G cities will have access to the same vendors if need be.
Additionally, having pre-existing agreements with key vendors can eliminate some of the problems that are typical when cities apply for FEMA reimbursement for disaster expenses. Existence of advance agreements helps the City provide faster and more effective response in disaster situations.

RESOLUTION NO. 2006-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ADOPTING THE AREA G JOINT POWERS AGREEMENT AMENDMENT, WHICH AUTHORIZES THE OFFICE OF DISASTER MANAGEMENT AREA G TO CREATE PRE-DISASTER PURCHASING AGREEMENTS ON BEHALF OF AREA G CITIES.
WHEREAS, during a catastrophic disaster event, critical supplies and equipment can be difficult to obtain, if they are available at all, and
WHEREAS, during a catastrophic disaster, local vendors may themselves be victims of the disaster and unable to provide critical supplies and equipment to cities, and
WHEREAS, during a catastrophic disaster, obtaining critically needed supplies and equipment is of the highest priority for savings lives, protecting property and providing food and shelter to disaster victims, and
WHEREAS, the existence of advance purchase and rental agreements with key vendors can substantially improve the City’s response capability, and
WHEREAS, the City of Rancho Palos Verdes seeks to provide the highest possible level of disaster response capability for its citizens, and
WHEREAS, such advance purchase and rental agreements do not in any way obligate the City of Rancho Palos Verdes in any manner to purchase supplies or rent equipment from any vendor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF RANCHO PALOS VERDES that we hereby adopt the Addendum to the Area G Joint Powers Authority Agreement and authorize the City Manager to sign the addendum on behalf of the City.

ADDENDUM TO JOINT POWERS AGREEMENT TO PROVIDE
This addendum is hereby incorporated in the Joint Powers Agreement (Agreement) for Disaster Management Area G to grant the Board authority regarding the purchase of emergency supplies by a member City.
The Board is authorized and instructed by the parties to this Agreement to enter into contingent purchase agreements with commercial vendors for equipment, materials, and supplies which the member cities could purchase with City funds in the event of an emergency or disaster. These contingent purchase agreements will be for the use by the member City should the member City determine the use of said agreements necessary. Disaster Management Area G will not make any purchases under these contingency purchase agreements.
