FROM: DIRECTOR OF PUBLIC WORKS DATE: NOVEMBER 7, 2006 SUBJECT: CITY HALL SEWER LATERAL REHABILITATION PROJECT 1. Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on October 17, 2006 to authorize staff to proceed with repairs to the sewer lateral system at the City Hall complex. 2. Adopt Resolution 2006-_____, a resolution of the City Council of the City of Rancho Palos Verdes amending resolution 2006-41, the budget appropriation for fiscal year 2006-2007, for a budget adjustment of $50,400 to the City’s General Fund for the repair of sewer laterals at the City Hall complex. FISCAL IMPACT Council authorized the expenditure of $50,400 on October 17, 2006 to construct the repairs to the sewer lateral system at the City Hall complex. Staff recommends adoption of the budget resolution to amend the General Fund - Building Maintenance Program for utility repair purposes account number 101-3008-431-43-00. BACKGROUND On October 17, 2006, the City Council found that an emergency exists concerning the repair of the City Hall sewer lateral pipes. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to repair the existing pipes. DISCUSSION Approval of both the informal bid process and the authorization of the Director of Public Works to negotiation and execute the construction contract with Bob & Marc Plumbing, and the expenditure of up to $50,400 for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1). In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the repair has not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until the project is completed. CURRENT STATUS Completion of the initial phase of work is anticipated during the week of November 6, 2006. Evaluation of the repairs needed to the main lateral and the associated cost estimate will be determined and negotiated during the initial repairs. Staff will advise the City Council of the scope, costs and schedule of this work when it is known. Respectfully submitted: Jim Bell Reviewed Les Evans Attachment: A) FY07-07 Statement of Estimated General Fund Reserves RESOLUTION NO. 2006- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS WHEREAS, Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all expenditures in excess of budgeted allocations must be by supplemental appropriation of the City Council; and WHEREAS, on June 6, 2006, the City Council of the City of Rancho Palos Verdes adopted Resolution 2006-41, approving a spending plan and authorizing a budget appropriation for the 2006-07 fiscal year; and WHEREAS, it is necessary for the City to allocate additional funds to repair the sewer lateral system at the City Hall complex; and WHEREAS, a budget increase in the Building Maintenance Program is necessary to authorize the expenditure of additional funds for repairs to the sewer lateral system at the City Hall complex; BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES: The following adjustments be made to the General Fund: Building Maintenance Program 101-3008-431-43-00 Utility Repairs $50,400 PASSED, APPROVED, AND ADOPTED THIS 7th DAY OF November 2006.
