SUBJECT: CITY HALL SEWER LATERAL REHABILITATION PROJECT
1. Review and reconfirm by a four/fifths (4/5) vote, the Council’s previous action on October 17, 2006 to authorize staff to proceed with repairs to the sewer lateral system at the City Hall complex.
Council authorized the expenditure of $50,400 on October 17, 2006 to construct the repairs to the sewer lateral system at the City Hall complex. Council authorized resolution 2006- on November 7, 2006 to amend the General Fund - Building Maintenance Program for utility repair purposes, account number 101-3008-431-43-00.
On October 17, 2006, the City Council found that an emergency exists concerning the repair of the City Hall sewer lateral pipes. This emergency situation will not permit a delay resulting from a competitive solicitation for bids to repair the existing pipes.
Approval of both the informal bid process and the authorization of the Director of Public Works to negotiation and execute the construction contract with Bob & Marc Plumbing, and the expenditure of up to $50,400 for this work required a four-fifths (4/5) vote of the Council under Public Contract Code Section 22050(a)(1).
In addition, Public Contract Code Section 22050(c)(1) requires that when a governing body takes action under Section 22050(a)(1), it must review that action and reaffirm it by a four-fifths vote at each subsequent regularly scheduled meeting until the action is terminated. Accordingly, because the repair has not yet been completed, staff has placed this item on tonight’s agenda. This item will be placed on each subsequent agenda until the project is completed.
The initial phase of work was substantially completed November 6, 2006. The scope of work on the remaining sewer lateral includes cleaning and repairing the line where needed. This work has been scheduled to begin on November 27, 2006, and should be completed within 5 days.
