Recommendation: Adopt a motion to waive reading in full of all ordinances presented at this meeting with consent of the waiver of reading deemed to be given by all Council Members after the reading of the title. 

2.         Approval of the Minutes (Morreale)
            Recommendation: Approve the Minutes of the March 29, 2008 Adjourned Regular Meeting.

3.         Used Oil Recycling Block Grant for FY 08-09 (Ramezani)
Recommendation: 1) Authorize the application of the FY 2008-09 (14th Cycle) used oil block grant to continue the used oil and filter recycling program for City of Rancho Palos Verdes (City) residents; and, 2) ADOPT RESOLUTION NO.
2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS FOR PAYMENT AS NECESSARY TO IMPLEMENT THE PROGRAM.

4.         Notice of Completion for the Arterial Rehabilitation Program:  STPL-5413 (007) (Bell)
            Recommendation: 1) Accept construction as complete; 2) Authorize the City Clerk to file a Notice of Completion with the County Recorder; and if no claims are filed within 35 days after recordation, and upon the contractor posting an acceptable warranty bond, notice the surety company to exonerate the Payment and Performance bonds; and, 3) Authorize the Director of Public Works to release the 10% retention payment, to All American Asphalt Company, 35 days after recordation of the Notice of Completion by the County Recorder contingent upon no claims being filed on the project, and the contractor posting an acceptable warranty bond.

5.         Citywide Landscaping and Lighting Maintenance District (Huey)
Recommendation:  1) ADOPT RESOLUTION NO. 2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, INITIATING PROCEEDINGS FOR THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 2008-2009 AND ORDERING THE PREPARATION OF AN ENGINEER’S REPORT PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, PART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS & HIGHWAYS CODE; 2) ADOPT RESOLUTION NO. 2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, APPROVING THE ENGINEER’S REPORT IN CONNECTION WITH THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT FOR FISCAL YEAR 2008-2009; 3) ADOPT RESOLUTION NO.

7.         Gifts for Parks (Rosenfeld)
            Recommendation: Accept Gifts for Parks donations and direct staff to prepare donor letters of appreciation for the Mayor’s signature.

8.         Approval of Agreement between the City and the Portuguese Bend Cooperative Nursery School (Rosenfeld)
            Recommendation: Approve and authorize the Mayor to execute the agreement between the City and the Portuguese Bend Cooperative Nursery School.

9.         Proposed Dolphin Statue in Sunset Point Park (Pfost)
Recommendation: Via Minute Order, approve the location and authorize the Director of Public Works to install a donated Dolphin Statue in Sunset Point Park.

10.       Continuation of Funding for the City/Palos Verdes Peninsula Land Conservancy (PVPLC) State Lobbyist (Rojas)       
Recommendation: ADOPT RESOLUTION NO. 2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, THEREBY APPROVING A BUDGET ADJUSTMENT FOR $18,000 TO FUND THE SERVICES OF MR. JOSEPH CAVES OF CONSERVATION STRATEGY GROUP FOR THE 2008 CALENDAR YEAR AS AN ADVOCATE OF THE CITY FOR SECURING STATE MONIES FOR THE CITY’S CONTINUING OPEN SPACE ACQUISITIONS.

12.       Residential Solid Waste and Recycling Rate Adjustments for USA Waste of California dba Waste Management of Los Angeles for FY 08-09 (Ramezani)
Recommendation: 1) Approve the maximum rates that USA Waste of California dba Waste Management of Los Angeles can charge single-family customers in FY 08-09; 2) Approve the maximum rates that USA Waste of California dba Waste Management of Los Angeles can charge multi-family customers in FY 08-09; 3) Increase the City’s FY 08-09 Collector Fee by $25,300; and, 4) Approve a change in the distribution of the amount of City's Collector Fee among several City Funds.

14.       Revision “MM” to the Trump National Golf Course Project (Pfost)
Recommendation: 1) ADOPT RESOLUTION NO. 2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, APPROVING ADDENDUM NO. 34 TO ENVIRONMENTAL IMPACT REPORT NO. 36; and, 2) ADOPT RESOLUTION NO. 2008-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING CONDITIONAL USE PERMIT NO. 162 TO ALLOW LOT 17 OF TRACT NO. 50667 TO GRADE OVER AN EXTREME SLOPE.

19.       2006-2007 Palos Verdes Peninsula Land Conservancy (PVPLC) Annual Report for the Palos Verdes Nature Preserve (Mihranian)
Recommendation: 1) Receive and file the 2006-2007 Annual Report submitted by the PVPLC for the Palos Verdes Nature Preserve; and, 2) Approve the 2008 Project List for the Forrestal Reserve.

20.       Adoption of Fire Hazard Severity Zone Maps (Rojas)
Recommendation: 1) ADOPT URGENCY ORDINANCE NO. ___U, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES DESIGNATING VERY HIGH FIRE HAZARD SEVERITY ZONES, AMENDING THE 2007 CALIFORNIA FIRE CODE, AMENDING TITLE 8 OF THE RANCHO PALOS VERDES MUNICIPAL CODE AND DECLARING THE URGENCY THEREOF; and, 2) INTRODUCE ORDINANCE NO. ___, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, DESIGNATING VERY HIGH FIRE HAZARD SEVERITY ZONES, AMENDING THE 2007 CALIFORNIA FIRE CODE, AND AMENDING TITLE 8 OF THE RANCHO PALOS VERDES MUNICIPAL CODE.

A point has been reached where, in the opinion of the City Council/Agency on the advice of its legal counsel, based on the below-described facts and circumstances, there is a significant exposure to litigation against the City Council/Agency:

Based on a threat of litigation received from Andrea Joannou on January 9, 2008 regarding 40 Cherry Hill in a meeting with City Manager Lehr, City Attorney Lynch and Director of Planning, Building and Code Enforcement Rojas.  A copy of the memorandum from the City Attorney documenting the threat of litigation that was made is on file in the City Clerk’s Office.
