REGULAR BUSINESS:

(60 mins)   4.         Conceptual Designs for Lower Hesse Park (Odom)
Recommendation: 1) Give staff direction regarding the plan for Lower Hesse Park, based on the conceptual designs developed by City consultant Mia Lehrer & Associates; and, 2) Direct staff to prepare the initial study and the appropriate level of environmental review required by the California Environmental Quality Act (CEQA) to analyze the potential development of Lower Hesse Park once the description of the project has been clarified by the City Council.

(60 mins)  5.        Processing Issues Related to the Proposed Annenberg Project at Lower Point Vicente (Mihranian)
Recommendation: 1) Receive a status update on the comments received from the National Park Service (NPS) and State Office of Grants and Local Services (OGALS) on the proposed project’s consistency with the Federal Program of Utilization and Federal grant restrictions that apply to Lower Point Vicente and affirm that a formal determination request as to the proposed project’s consistency with the Program of Utilization should be submitted to the OGALS and NPS at the conclusion of the City’s entitlement process; 2) Affirm that a General Plan Amendment application is not necessary to be processed for the proposed project; and, 3) Direct the Planning Commission to continue processing the currently requested Conditional Use Permit, Grading and Coastal Permit entitlement applications for the proposed Annenberg Project at Lower Point Vicente.

(5 mins)        7.        Draft 2010 Standardized Emergency Management System (SEMS)/National Incident Management System (NIMS) Multi-Hazard Functional Emergency Operations Plan (Petru/Bonano)
Recommendation:  1) Receive an introduction to the Draft City of Rancho Palos Verdes 2010 SEMS/NIMS Multi-Hazard Functional Emergency Operations Plan (EOP); and, 2) Continue the item to November 30, 2010 for final approval.

(20 mins)   8.         Municipal Area Express (MAX) (Raymond)
Recommendation:  Direct Staff to notify interested parties (e.g., riders and agencies) that on November 30, 2010, the City will consider whether to continue its participation in the commuter transportation transit service known as Municipal Area Express (MAX).  Notification in advance of the November 30th City Council meeting would include signs posted on MAX bus stops, a press release, Listserv messages and a notification on the City’s website.

Recommendation: ADOPT RESOLUTION NO. 2010-___, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, AMENDING THE CITY’S MAXIMUM MONTHLY CONTRIBUTION AMOUNTS FOR EMPLOYEE HEALTH INSURANCE PREMIUMS FOR CALENDAR YEAR 2011.

A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based on the below-described facts and circumstances, there is a significant exposure to litigation against the City:

Based on an implied threat of litigation by Attorney Scott Sommer in letters to Community Development Director Joel Rojas dated April 16, 2010 and July 15, 2010.  Copies of the letters from the Mr. Sommer are on file in the City Clerk’s Office.
