1. APPEAL OF GRADING PERMIT, SITE PLAN REVIEW PERMIT, AND LOT LINE ADJUSTMENT (CASE NO. ZON2003-00349 AND SUB2003-00009): 5251 Rolling Ridge / Slagg (Appellant) (DB)

(This item was continued from the February 10, 2004 Planning Commission meeting)

Request: A request to overturn the Director’s approval of a Grading Permit, Site Plan Review, and Lot Line Adjustment (Case No. ZON2003-00349 and SUB2003-00009), which allows the construction of a 5,482 square foot single family residence, a pool with spa and related equipment to the rear (south side) of the proposed residence, 517 cubic yards of grading, and the reconfiguration of the side property line.

Recommendation: Staff recommends that the Planning Commission review the revised project and if deemed acceptable, adopt P.C. Resolution No. 2004-__, thereby denying the appeal and upholding the Director’s approval of the Grading Permit, Site Plan Review, and Lot Line Adjustment (Case No. ZON2003-00349 and SUB2003-00009), as modified.

Request: A request to construct a 732 square foot two story addition to an existing 2,458 square foot residence. The proposed addition, measures 23’-3" high, as measured from the lowest grade adjacent to the building foundation/slab (99’-6") to the highest ridgeline of the residence (122’-9"), and 22’-11" high, as measured from the highest elevation of existing building pad covered by structure (99’-10") to the highest ridgeline of the residence.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the Height Variation (Case No. ZON2003-00549).

3. HEIGHT VARIATION AND MINOR EXCEPTION PERMIT (CASE ZON2003-00595): 7442 Via Lorado / Thursby (DB)

Request: A request to construct a 1,035 square foot two story addition to an existing 2,820 square foot residence. The proposed addition, measures 26’ high, as measured from the lowest grade adjacent to the building foundation/slab (281.74’) to the highest ridgeline of the residence (307.74’), and 24’ high, as measured from the highest elevation of existing building pad covered by structure (283.74’) to the highest ridgeline of the residence. Additionally, the request is to allow portions of the addition to encroach 2’ into the street side setback.

Recommendation: Staff recommends that the Planning Commission adopt P.C. Resolution No. 2004-___; thereby approving, with conditions, the Height Variation and Minor Exception Permit (Case No. ZON2003-00595).

4. VIEW RESTORATION PERMIT NO. 165: 5403, 5411, and 5417 Littlebow Road / Lee (5403), Fukunaga (5411), and Spolher (5417) (JA)

Request: A request to trim and/or remove foliage located at 5434 Manitowac Road, in order to restore the views from 5403, 5411, and 5417 Littlebow Road.

Recommendation: Staff recommends that the Planning Commission Adopt P.C. Resolution No. 2004-___, approving VRP No. 165 to trim and/or remove foliage on a property located at 5434 Manitowac Road in order to restore the applicants’ view.

5. CODE AMENDMENT REGARDING 16' BUILDING HEIGHT (ZON2003-00417): City (AM)

5A. ORDINANCE NO. 400U

Request: A request to review the new Height Variation application findings.

Recommendation: Staff recommends that the Planning Commission review the new language of the Height Variation application findings contained in Urgency Ordinance No. 400U and provide the City Council with any feedback as to whether additional clarifying language is warranted.
